Staff recommends approval of the request with the 9 conditions listed in the staff <br />report. <br /> <br />Chair Ropp opened the public hearing. <br /> <br />Mark Schneider of TLM Land Holdings, applicant, stated that Peter Raatikka of <br />Hakanson Anderson and Associates has received City Engineer T eny Maurer's comments <br />and will be addressing all of the items of concern. <br /> <br />There being no further public comment, Chair Ropp closed the public hearing. <br /> <br />Chair Ropp asked if there were existing structures on the site. Mr. Leeseberg stated that <br />there are homes across from Lot 2, Block 1 that are not part of the development and that <br />there are structures on site that will be removed. <br /> <br />Commissioner Anderson stated that there are significant issues that need to be addressed, <br />but that he would be comfortable recommending approval if a condition was included that <br />all of the City Engineer's issues are addressed. <br /> <br />Commissioner Pederson asked for clarification on the variance for Lot 2, Block 1. City <br />Engineer T eny Maurer stated that the lot is 100 feet deep and that the City ordinance <br />requires a 130-foot lot depth. <br /> <br />Commissioner Offerman stated that he would support approval of the request if the <br />extension of Nixon Street was included. Mr. Maurer requested that the Commission make <br />the extension a condition of approval (Condition No. 10) to clearly state that the Planning <br />Commission felt the extension was appropriate. <br /> <br />Chair Ropp stated that he concurred with the added condition, and that he had no other <br />issues with the request. <br /> <br />MOTION BY COMMISSIONER STEVENS AND SECONDED BY <br />COMMISSIONER ANDERSON TO RECOMMEND APPROVAL OF THE <br />REQUEST BY TLM LAND HOLDINGS, LLC FOR PRELIMINARY PLAT <br />APPROVAL OF BELMONT ESTATES, CASE NO. P 04-17, WITH THE <br />FOLLOWING CONDITIONS: <br /> <br />1. ALL COMMENTS OF THE CITY ENGINEER SHALL BE <br />ADDRESSED. <br />2. ALL COMMENTS OF SHERBURNE COUNTY SHALL BE <br />ADDRESSED. <br />3. A SEALCOAT FEE SHALL BE PAID PRIOR TO RELEASING THE <br />PLAT FOR RECORDING. <br />4. A LETTER OF CREDIT IN THE AMOUNT OF 100% OF THE COST <br />OF THE IMPROVEMENTS SHALL BE SUBMITTED PRIOR TO <br />RELEASING THE PLAT FOR RECORDING. <br />5. THE APPLICANT SHALL EXECUTE A DEVELOPER'S <br />AGREEMENT OUTLINING THE TERMS AND CONDITIONS OF <br />APPROVAL. <br />6. PARK DEDICATION SHALL BE IN CASH FOR 29 LOTS. <br />
