<br />Planning Commission Minutes <br />March 26, 2002 <br />Page 6 <br /> <br />e <br /> <br />Commissioner Franz asked why Mr. Smith felt the 3:00 a.m. closing was necessary on Friday <br />and Saturday nights. Mr. Smith stated that this facility will be the only one if its type within <br />18 miles. He stated that hours of operation of other billiard halls in large population areas <br />average 10:00 a.m. - 4 a.m. or 6:00 a.m. and that Fridays and Saturday are their busiest days <br />of the week. <br /> <br />Discussion following regarding staffing of the billiard hall. Some of the Commissioners <br />expressed concern that staffing needs to be adequate in order to check identification of <br />juveniles and to provide surveillance inside and outside of the facility. Mr. Smith noted that <br />the curfew time will be announced and underage smoking by teens will not be allowed. <br /> <br />Commissioner Mesich asked if other facilities employed a police officer or security person. <br />Mr. Smith stated that he has not heard of this being done any where in this state. <br /> <br />Commissioner Baker stated that he is a pool player and that he has not seen a police officer <br />in any of the billiard halls he has visited. He did not feel it was realistic for a billiard hall to <br />be maintained as non-smoking. Commissioner Baker stated that he felt it would be difficult <br />to require the employees to police the grounds. <br /> <br />Commissioner Mesich felt that including this condition would enforceable if drinking and <br />loitering were to become an ongoing problem. <br /> <br />e <br /> <br />Ms. McPherson stated that the employees could be asked to walk through the areas every <br />hour or every-other-hour and if issues arose, the police would be contacted. She felt that by <br />policing the parking lot, undesirable activities would be eliminated. <br /> <br />Commissioner Baker asked City Attorney Peter Beck if he felt the condition would be <br />enforceable. Mr. Beck stated that he felt that it would be enforceable but additional <br />conditions could be included if the Commission they were necessary. <br /> <br />Commissioner Pederson was concerned that the lighting on the rear of the building may <br />impact the adjacent neighbors, if the facility were open till 3:00 a.m. Commissioner Franz <br />explained that there is a large privacy wall along the property line from Coborns to Menards <br />so that the lighting should not affect the residential homes. <br /> <br />Commissioner Ropp stated that he has some concern that patrons would come from the <br />bars when they closed and then come to play pool. He questioned whether or not this <br />would be introducing a risk factor to the residential neighborhood. Commissioner Mesich <br />stated that it may be a good idea for bar patrons to go play pool for a while before going <br />home and that he felt the late hours of operation were necessary for the business to survive. <br /> <br />Chair Pederson, Commissioner Baker, and Commissioner Anderson concurred that they did <br />not have a problem with the hours of operation. Commissioner Jenson stated he did have <br />some concern that the residential area may be impacted. <br /> <br />Discussion followed regarding the City's ability to review the conditional use permit. Mr. <br />Beck stated that he felt it would be difficult to go back and change the hours of operation, <br />once they were established in the conditional use permit. Ms. McPherson noted that a <br />billiard license will be reviewed annually by the City. <br /> <br />e <br />
