<br />Planning Commission Minutes <br />March 26, 2002 <br />Page 7 <br /> <br />e <br /> <br />There being no further public comment, Chair Pederson closed the public hearing. <br /> <br />It was the consensus of the Commission to act on the conditional use permits for the <br />building and for the billiard hall separately. Mr. Beck noted that if there were issues of <br />noncompliance with the billiard hall, the conditional use could be revoked. <br /> <br />COMMISSIONER MESICH MOVED TO RECOMMEND APPROVAL OF THE <br />REQUEST BY PHOENIX ENTERPRISES FOR A CONDITIONAL USE <br />PERMIT TO ALLOW EXPANSION OF THE NORTHBOUND CROSSING <br />BUILDING, CASE NO. CU 02-08, WITH THE FOLLOWING CONDITION: <br /> <br />1. THE BUILDING ADDITION SHALL COMPLY WITH ALL APPLICABLE <br />BUILDING CODES. <br />2. SECURITY LIGHTING BE PROVIDED ON THE BACK OF THE <br />BUILDING. <br /> <br />COMMISSIONER PEDERSON SECONDED THE MOTION. THE MOTION <br />CARRIED 7-0. <br /> <br />e <br /> <br />COMMISSIONER MESICH MOVED TO RECOMMEND APPROVAL OF THE <br />REQUEST BY PHOENIX ENTERPRISES AND BRUCE SMITH FOR A <br />CONDITIONAL USE PERMIT FOR A BILLIARD HALL, CASE NO. CU 02-08, <br />WITH THE FOLLOWING CONDITIONS: <br /> <br />1. THE EMPLOYEES SHALL POST IN PLAIN SIGHT AND STRICTLY <br />ENFORCE THE CITY OF ELK RIVER'S CURFEW REQUIREMENTS. <br /> <br />2. THE EMPLOYEES SHALL POLICE THE GROUNDS AND NOTIFY THE <br />POLICE DEPARTMENT IF THERE ARE PROBLEMS INSIDE OR <br />OUTSIDE OF THE BUILDING. <br /> <br />3. WINDOWS OF THE BILLIARD HALL SHALL REMAIN UNCOVERED <br />AND UNOBSTRUCTED TO ALLOW VISIBILITY. <br /> <br />4. NO SALES OF CIGARETTES OR USE OF CIGARETTES BY MINORS ON <br />THE PREMISES. <br /> <br />5. THE APPLICANT SHALL OBTAIN APPROVAL OF A BILLIARD HALL <br />LICENSE FROM THE CITY OF ELK RIVER. <br /> <br />CHAIR PEDERSON SECONDED THE MOTION.
