September 21, 1995 <br />Mr. Bob Minton <br />Chairman, Elk River Comprehensive Plan <br />Steering Committee <br />13065 Orono Parkway <br />Elk River, MN 55330 <br />SUBJECT: Commercial Development of East Highway 169 Corridor <br />Dear Chairman Minton & Steering Committee Representatives: <br />Phoenix Enterprises, LLC, in conjunction with Everett, Verna and Dale Specht, are the owners of <br />record of certain property east of I-fighway 169 generally between 193rd and 197th Avenues. In that <br />regard, and in reference to the recommendations being considered by the Steering Committee through <br />the draft Comprehensive Plan Update, this company intends to seek approval to continue the <br />Highway Commercial (C-3) zoning district from its temporary boundary just north of 193rd Avenue <br />to the more northerly boundary of 197th Avenue. <br />Our rationale is supported by the following facts: <br />The Hillside Crossing site was platted and developed to utilize the C-3 definition. <br />2. The grocery store was designed and built to provide adequate and logical expansion to the <br />north to support future community and regional shopping needs. This factor was an integral <br />part of the store owner's decision to purchase the site and invest significant capital into the <br />project, and consequently, the community. <br />3. The infrastructure was planned, designed and built to adequately accept the future commercial <br />activities generally projected to occur along this corridor. This includes the commonly <br />acceptable frontage road design parallel to Highway 169 (Evans Street), a water and sewer <br />design, location and accessibility which are conducive to commercial development, and <br />appropriate design and sizing of the storm sewer and retention pond system (i.e., a 48" <br />overflow pipe is installed under 193rd Avenue to drain into the city's regional pond). <br />241 Main Street, Suite 4 <br />P.O.
