Mr. Maurer indicated that MnDOT discovered that the right of way agreement
previously approved by the City Council has lapsed and in order to get the approximately
$100,000 of federal money remaining for the purchase of right of way along the Twin Lakes
Road Corridor, the City Council needs to adopt a new agency agreement.

MOVED BY COUNCILMEMBER DIETZ AND SECONDED BY
COUNCILMEMBER MOTIN TO ADOPT RESOLUTION 05-49 ADOPTING
MINNESOTA DEPARTMENT OF TRANSPORTATION AGENCY
AGREEMENT NO. 86472 FOR FEDERAL PARTICIPATION IN RIGHT OF
WAY FOR S.P. 204-133-02 AND 71-613-08. Sewer Revenue Refunding Bonds. Series 2005B

Finance and Administrative Services Director Lori Johnson indicated that staff is requesting
that the Council authorize the sale of $1,085,000 General Obligation Improvement Bonds to
finance construction of the 2005 Street rehabilitation project and $1,695,000 in General
Obligation Sewer Revenue Refunding Bonds to refund the $2,655,000 sewer revenue bonds
of 1996. Ms. Johnson stated that the estimated savings on the refunding issue is
approximately $102,000. She also noted that all other bonds have been reviewed to
determine which should be refunded and only the 1996 sewer bonds generate enough
interest savings to justify refunding.

Ms. Johnson stated that the resolutions call for the Council to award the sale of the bonds
on May 16,2005 and representatives from Ehlers & Associates will be present at that
meeting to present the bid results.

MOVED BY COUNCILMEMBER MOTIN AND SECONDED BY
COUNCILMEMBER GUMPHREY TO ADOPT RESOLUTION 05-50
PROVIDING FOR THE SALE OF $1,085,000 G.O.
