<br />. <br /> <br />. <br /> <br />. <br /> <br />City Council Minutes <br />May 2, 2005 <br /> <br />Page 7 <br /> <br />Councihnember Dietz questioned if action on this item could be tabled until the Council has <br />a chance to meet with the developer in that area regarding a large proposed development on <br />the Holzem property that would also require extension of the Urban Service Area. <br />Director of Planning Michele McPherson stated that the Council has untilJune 27, 2005 to <br />take action on this item. <br /> <br />Councihnember Dietz indicated that there are issues with the Holzem property that need to <br />be addressed and he does not want to see the Council deny this request solely because the <br />120-day time limit has ron out. <br /> <br />City Attorney Peter Beck indicated that the Council has the most discretion on these types <br />of requests and if the Council is not prepared to take action on this item by that deadline, <br />they could request an extension from the petitioner rather than deny the request. If the <br />petitioner does not wish to have an extension, the city could chose to deny the request. Mr. <br />Beck noted that even if the Council denies the request, the city can always initiate a similar <br />project at a later date. <br /> <br />MOVED BY COUNCILMEMBER DIETZ AND SECONDED BY <br />COUNCILMEMBER GUMPHREY TO TABLE THE REQUEST BY JEFF <br />WERNER TO AMEND THE COMPREHENSIVE PLAN TO INCLUDE <br />CERTAIN PROPERTIES IN THE URBAN SERVICE AREA, CASE NO. LU 05- <br />01 TO MAY 16,2005. MOTION CARRIED 5-0. <br /> <br />Councihnember Dietz noted that the Council will be meeting with the proposed developer <br />of the Holzem property at the May 9, 2005 Council Worksession and all interested property <br />owners are invited. <br /> <br />5.4. <br /> <br />Request by Anderson-Johnson Associates. Inc. for Conditional Use Permit to Construct <br />East Elk River Elementary School. Public Hearing. Case No. CU 05-08 <br /> <br />Staff report submitted by Scott Harlicker. Mr. Harlicker indicated that the applicant is <br />requesting a conditional use permit to construct an elementary school at the southwest <br />comer of Twin Lakes Road (CR13) and Cleveland Street (CR40). Mr. Harlicker provided an <br />overview of the project. <br /> <br />Mayor Klinzing opened the public hearing. There being no one to speak on this issue, <br />Mayor Klinzing closed the public hearing. <br /> <br />Mayor Klinzing questioned if it is safe to have the children crossing the bus parking area to <br />get to the playground. <br /> <br />Jay Pomeroy, Landscape Architect for Anderson-Johnson Associates - indicated that <br />the bus loading area will also serve as the hard surface play area with markings for "four- <br />square" and "hop-scotch". Mr. Pomeroy stated that the area will be gated off from all <br />vehicles during the day. It was noted that Parker, Lincoln, and Zimmerman Elementary <br />Schools all have this dual purpose lot/play area and it works well. <br /> <br />Councilmember Dietz questioned why the school is proposed to be a two-story building. <br />
