<br /> <br /> <br /> <br /> <br />~ <br /> <br />City Council Minutes <br />December 21, 1981 <br />Page Three <br /> <br />It was the general consensus of the City Council that Mr. John Pearce, the City <br />Administrator, and the Mayor provide to the City Council a more specific outline <br />of the type of projects and tasks .and how they were to be accomplished by the <br />Advisory Committee. <br /> <br />6. Barrington Place Pay Estimate Number 3 <br /> <br />The City Administrator indicated that Pay Estimate Number 3 for Barrington Place <br />i:n the amount of $78,967.13 has been reviewed and approved by the engineers on the <br />project and recommended for payment. <br /> <br />Councilman Toth indicated that he.did not want to approve payment for Barrington <br />Place until the Elk Hills Drive road repair has been completed and further in- <br />dicated that the repair project should have been completed by this time. <br /> <br />The City Administrator indicated that the contract had a provision for liquidation <br />damages and suggested that the City pursue that possibility in order to get the <br />road completed. <br /> <br />COUNCILMAN DUITSMAN MOVED TO ~RIZE THE CITY ADMINISTRATOR TO REQUIRE THE COM- <br />PLETION OF THE REPAIR OF ELK HILLS DRIVE BY THE CONTRACTOR BEFORE JANUARY 4, 1982, <br />AND TO PURSUE LIQUIDATION DAMAGES.THR,OUGH THE CONSULTING ENGINEERS SHOULD THE RE- <br />PAIRS NOT BE COMPLETED. COUNCILMAN ENGSTROM SECONDED THE MOTION. THE MOTION <br />PASSED 4-0. <br /> <br />COUNCILMAN DUITSMAN MOVED TO APPROVE PAY ESTIMATE #3 FOR BARRINGTON PLACE IN THE <br />AMOUNT OF $78,967.13. COUNCILMAN ENGSTROM SECONDED THE MOTION. THE MOTION PASSED <br />3-1. COUNCILMAN TOTH OPPOSED. <br /> <br />7. 3.2% Off-Sale Beer License for Food and Fuel <br /> <br />The City Administrator indicated that Mr. Gerry Bowen, owner of the Food and Fuel <br />Store, has requested approval of a 3.2% off-sale beer license for his business. <br /> <br />Councilman Toth questioned the investigation of Mr. Gerry Bowen regarding the <br />3.2% off sale beer license by the Police Department. <br /> <br />Councilman Engstrom indicated that he was not in favor of the sale of beer at a <br />gas station. <br /> <br />Councilman Schuldt indicated that. he felt that the City Council should not approve <br />a beer license for one convenience store and not another. <br /> <br />COUNCILMAN ENGSTROM MOVED TO DENY A 3.2% OFF-SALE BEER LICENSE FOR FOOD AND FUEL <br />COUNCILMAN TOTH SECONDED. THE MOTION. THE MOTION. PASSED 3-1. COUNCILMAN SCHULDT <br />OPPOSED. <br />
