He felt there were advantages to both the City and Cargill through a <br /> conditional use permit, and that Cargill would have more certainty for the long <br /> term. Mr. Beck noted that if Cargill found it necessary in the future, a conditional <br /> use permit could be amended. <br /> Discussion followed regarding whether to act on the issues and pass on to the <br /> City Council, or to table the requests to the next meeting, to allow staff more time <br /> to review the changes proposed by Cargill. <br /> Chair Mesich opened the public hearing. <br /> Alex Class, representing Dorsey& Whitney, stated that Cargill is opposed to the <br /> amendments as proposed and that their expectations are that the zoning <br /> amendments to provide Cargill certainty for continuing their operation for the <br /> long term. She stated that they feel they are making progress with staff and that <br /> she realizes staff did not have an opportunity to see the revisions proposed in the <br /> February 23rd letter. She stated that they did not have a problem moving the <br /> requests forward to the City Council level, but that they are not waiving any of <br /> their legal options to oppose the amendment. <br /> Chair Mesich stated that he felt any major issues could be addressed by the <br /> Planning Commission through the conditional use permit site plan review. <br /> II <br /> It was the consensus of the Commissioners to table these issues. <br /> COMMISSIONER BAKER MOVED TO TABLE THE REQUESTS BY THE CITY OF ELK RIVER <br /> FOR ORDINANCE AMENDMENTS, LAND USE AMENDMENT AND REZONING TO THE <br /> MARCH 27, 2001 PLANNING COMMISSION MEETING. COMMISSIONER JOHNSON <br /> SECONDED THE MOTION. THE MOTION CARRIED 7-0. <br /> 5.16. Request by City of Elk River for Ordinance Amendment to amend definitions of <br /> Government facilities, government offices and to amend conditional uses in the <br /> residential districts, Public Hearing-Case No. OA 01-03 <br /> Michele McPherson stated that Sherburne County has asked that this item be <br /> tabled to the March 27, 2001 Planning Commission meeting, in order to further <br /> discuss the proposed definitions. <br /> COMMISSIONER BAKER MOVED TO TABLE THE REQUEST BY THE CITY OF ELK RIVER <br /> FOR A ORDINANCE AMENDMENT TO AMEND DEFINITIONS OF GOVERNMENT <br /> FACILITIES, GOVERNMENT OFFICES, AND TO AMEND CONDITIONAL USES IN THE <br /> RESIDENTIAL DISTRICTS, CASE NO.
