Planning Commission Minutes February 27,2001 Page 18 • that the City is proposing a broad agricultural use for the Cargill property, and that specific uses would be addressed through the conditional use permit process. He felt there were advantages to both the City and Cargill through a conditional use permit, and that Cargill would have more certainty for the long term. Mr. Beck noted that if Cargill found it necessary in the future, a conditional use permit could be amended. Discussion followed regarding whether to act on the issues and pass on to the City Council, or to table the requests to the next meeting, to allow staff more time to review the changes proposed by Cargill. Chair Mesich opened the public hearing. Alex Class, representing Dorsey& Whitney, stated that Cargill is opposed to the amendments as proposed and that their expectations are that the zoning amendments to provide Cargill certainty for continuing their operation for the long term. She stated that they feel they are making progress with staff and that she realizes staff did not have an opportunity to see the revisions proposed in the February 23rd letter. She stated that they did not have a problem moving the requests forward to the City Council level, but that they are not waiving any of their legal options to oppose the amendment. Chair Mesich stated that he felt any major issues could be addressed by the Planning Commission through the conditional use permit site plan review. II It was the consensus of the Commissioners to table these issues. COMMISSIONER BAKER MOVED TO TABLE THE REQUESTS BY THE CITY OF ELK RIVER FOR ORDINANCE AMENDMENTS, LAND USE AMENDMENT AND REZONING TO THE MARCH 27, 2001 PLANNING COMMISSION MEETING. COMMISSIONER JOHNSON SECONDED THE MOTION. THE MOTION CARRIED 7-0. 5.16. Request by City of Elk River for Ordinance Amendment to amend definitions of Government facilities, government offices and to amend conditional uses in the residential districts, Public Hearing-Case No. OA 01-03 Michele McPherson stated that Sherburne County has asked that this item be tabled to the March 27, 2001 Planning Commission meeting, in order to further discuss the proposed definitions. COMMISSIONER BAKER MOVED TO TABLE THE REQUEST BY THE CITY OF ELK RIVER FOR A ORDINANCE AMENDMENT TO AMEND DEFINITIONS OF GOVERNMENT FACILITIES, GOVERNMENT OFFICES, AND TO AMEND CONDITIONAL USES IN THE RESIDENTIAL DISTRICTS, CASE NO. OA 01-03. COMMISSIONER CHAMBERS SECONDED THE MOTION. THE MOTION CARRIED 7-0. 5.17. Request by City of Elk River for Ordinance Amendment to Amend Sections of the Cluster Ordinance, Public Hearing-Case No. OA 01-01 Scott Harlicker reviewed the cluster ordinance revisions recommended by the Planning Commission at the January 23, 2001 meeting.
