ZONING ORDINANCE <br /> The Land Use Plan and the zoning ordinance be However, the <br /> plan indicates only broad categories for genera ,ning ordinance <br /> delineates exact boundaries and specific uses fc ming ordinance <br /> specifies the detailed regulations within the vario _..,., ice serves as a <br /> primary tool for the implementation of the Comprenensive Plan. <br /> The purpose of the zoning ordinance as defined by Section 900.02 of the City Code is: <br /> To protect and promote the health, safety, morals and general welfare by lessening <br /> congestion in the public rights-of-way; securing safety from fire, panic and other dangers; <br /> providing adequate light and air; facilitating the adequate provision of water, sewage and <br /> other public services and facilities, conserving the values of properties and encouraging the <br /> appropriate use of land; promoting well-managed and staged development of residential, <br /> commercial, industrial, recreation and public areas; conserving and managing the use of <br /> natural resources and agricultural lands. <br /> The purpose of the zoning ordinance also includes the purposes set forth in the Minnesota <br /> • Municipal Planning Act. <br /> 3. SUBDIVISION REGULATIONS <br /> Subdivision regulations are ordinances adopted by the city governing the process of <br /> converting raw land into building sites. They are authorized by the Municipal Planning Act, <br /> Minn. Stat. , Subdivision of the statute sets forth the authority and purposes of the <br /> subdivision regulations. The city has adopted subdivision regulations, currently codified in the <br /> Elk River City Code, Section 1008. The primary control device is a mandatory plat approval <br /> procedure, under which a developer is not permitted to make improvements or to divide and <br /> sell land until city approval is obtained for a plat detailing the proposed design, dedicated <br /> lands, and street and utility systems of the subdivision. <br /> The subdivision regulations serve an important role in implementation of the Comprehensive <br /> Plan. They enable coordination of otherwise unrelated plans of a great many individual <br /> developers. They assure that provision is made for such major elements of the land <br /> development plan as rights-of-way for transportation corridors, parks, water and sewer lines, <br /> and surface water management systems. Also, they enable control of the internal design of <br /> each new subdivision so its pattern of streets, utilities, drainage systems, lots, and other facilities <br /> will be safe and economical to provide and maintain. <br /> To ensure conformity in standards, the City should review its subdivision regulations with respect <br /> to the goals, policies, plans and actions specified in this Comprehensive Plan. This review <br /> should take into account, but not be limited to, lot sizes and frontage requirements. <br /> • <br />
