Ms. Nussbaum indicated that thei <br />fryers hut would like to be allowed to have a <br /> <br />ey have 300 laying chickens, 100 <br />, ducks and geese, as they are also <br />primary business is eggs and <br />least 100 ducks and geese. <br /> <br />General discussion was carried on regarding t e number of fowl and the type of <br />fowl allowed. Discussion was also carried on regarding the City's nuisance or- <br />dinance. Further discussion was also carried on regarding the allowing of turkey, <br />ducks and geese and whether they would be hou ed in the barn or just penned up <br />on the property. <br /> <br />Councilmember Gunkel indicated that she has s me problems with placing restrictions <br />on the variance as the farm property was ther prior to the areas being platted. <br /> <br />Mr. Rick Breezee, Building and Zoning Administrator, indicated that the farm property <br />was there prior to the various platted areas, and further indicated that the City's <br />Zoning Ordinance allows for the setback requi ements for agricultural buildings, <br />as neighbors, whether in a platted area or not, have rights as well. <br /> <br />Mr. Warren Williams indicated that he felt the Nussbaum property was a little <br />different situation, as it is a small farm of approximately 11 acres which is <br />generally considered a hobby farm. Mr. Williams indicated that if the farm was <br />150 acres, the platted areas would not be as close. Mr. Williams indicated that <br />the previous owners of the Nussbaum property did not have farm animals and that <br />residents in the area built their homes based upon the fact that there were not <br />animals on the farm. <br /> <br />COUNCILMEMBER DUITSMAN MOVED TO APPROVE THE AR YARD VARIANCE SETBACK RE UEST <br />AND THE VARIANCE FROM THE CITY'S SETBACK REQ IREMENTS FROM PLATTED AREAS OR <br />RESIDENCES IN THE A.;...l ZONE FOR AN ACCESSORY UILDING FOR THE NUSSBAUMS AT 12831 <br />RANCH ROAD, WITH THE STIPULATION THAT THE NUSSBAUMS BE RESTRICTED TO 500 FOWL, <br />EXCLUDING TURKEYS, AND 25 ADULT ANIMALS TO I CLUDE SHEEP, GOATS AND NO MORE THAN <br />THREE HORSES, AND THAT ANY ANIMALS KEPT OUT F DOORS ARE TO BE PENNED OR MAIN- <br />TAINED IN AN AREA SOUTH AND WEST OF THE BARN AND THAT THE PROVISIONS OF THE <br />NUISANCE ORDINANCE SPECIFICALLY APPLY TO THE NUSSBAUM PROPERTY. COUNCILMEMBER <br />GUNKEL SECONDED THE MOTION. THE MOTION PASS D 3-0. <br /> <br />15. Tescom Cor oration Administrative Subdivisio - Public Hearin <br /> <br />Mayor Hinkle indicated that the Tescom Corpo ation located at 12616 Industrial <br />Boulevard is requesting an administrative su division to allow them to add a two- <br />acre parcel of property to their existing 4. 6 acre parcel of property. <br /> <br />The City Administrator indicated that the Ie a1 description as proposed will change <br />slightly as there are MSA standards for the urve of the road adjoining the Tescom <br />property. <br /> <br />Discussion was carried on regarding the ease ent requirements. The City Admin- <br />istrator indicated that the easements will b a part of the administrative <br />subdivision plat. <br />
