Zoning Ordinance Amendment to Permit Gas Stations as Conditional Uses in C-1 <br />and C-2 Zones - Public Hearing <br /> <br />Councilmember Schuldt indicated that over the past y:earsthe City Council and <br />Planning Commission have discussed at various times the desirability of allowing <br />gas stations in a C-1, or downtown commercial zone. Councilmember Schuldt further <br />indicated that it has been the general feeling that if gas stations could be <br />maintained in a clean and neat manner, they could be a benefit to the downtown <br />community. Councilmember Schuldt further indicated that if gas stations were <br />allowed as a conditional use in a C-1 or C-2 district, each could be considered <br />se.parately and on its own merits. Councilmember Schuldt further indicated that <br />the City Council could retain a significant amount of control over the appearance, <br />access and other characteristics associated with gas stations in downtown areas, <br />if they were allowed as a conditional use. Councilmember Schuldt indicated that <br />the issue is being considered as Beaudry Oil has requested permission to improve <br />their facility in the downtown area. <br /> <br />Discussion was carried on reg~rding the definition of a gas station. It was <br />the consensus of the City Council that the Zoning Ordinance amendment would permit <br />auto service stations as a conditional use in a C~l zone, as a service station <br />could provide service to automobiles as well as gas. Discussion was then carried <br />on regarding Beaudry Oil specifically, and the car wash as part of the gas service <br />station. The City Administrator indicated that the car wash could remain at <br />Beaudry Oil as a nonconforming use, and that Beaudry Oil would be able to continue <br />normal maintenance of the car wash portion of the business. <br /> <br />Mayor Hinkle indicated that he did not feel car washes should be allowed in a C-1 <br />and a C-2 zoning district, and that the car wash at Beaudry Oil should remain a <br />nonconforming use. <br /> <br />COUNCILMEMBER GUNKEL MOVED TO APPROVE A ZONING ORDINANCE AMENDMENT THAT WOULD <br />ALLOW AUTO SERVICE STATIONS IN A C-1 ANDC-2 ZONING DISTRICT. COUNCILMEMBER ENGSTROM <br />SECONDED THE MOTION . THE MOTION PASSED 4-0. <br /> <br />13. Zoning Ordinance Amendment to.Permit Used Car Lots as a Conditional Use in C-3A <br />Zones - Public Hearing <br /> <br />The City Administrator indicated that at the present time the City's Zoning Ordinance <br />is silent regarding used car lots. The City Administrator further indicated that <br />in the City staff's review of the interpretation of the ordinance, the City staff <br />has found that there is a difference between new and used car lots, and therefore, <br />should be reflected in the City's Zoning Ordinance. The City Administrator in- <br />dicated that the Planning Commission considered a zoning Ordinance amendment to <br />allow used cars a conditional use in a C-3A zone, and voted unanimously to recom- <br />mend to the City Council that the City Council approve an amendment to allow used <br />cars as a conditional use in a C-3Azone. <br /> <br />Mayor Hinkle opened the public hearing. Mr. Russ Welton indi<tated that he was <br />interested in having used cars for sale in the parking lot next to Chip Martin's <br />building. Mr. Welton indicated that he has the body shop at his home and needs <br />space to show his used cars. <br />
