The City <br />Administrator indicated that the Planning Commission, on a 5-1 vote, voted to <br />recommend approval of a variance with the following conditions: <br /> <br />1) that a maximum of three horse and no other livestock or poultry be housed on the <br />property <br />2) that an existing temporary lean-to building in the frond yard be removed <br />3) that Mr. Omitt obtain the necessary building permit for the structure <br />4) that the livestock housed on the property be pastured in the rear of the property. <br /> <br />The City Administrator further indicated that the Planning Commission also discussed <br />a requirement the Mr. Omitt establish some grass cover on the front of the property <br />which is currently dirt. <br /> <br />Discussion was carried on regarding the Planning Commission's recommendation that <br />only three horses be housed on the property, as Heavenly Hills Addition is an unplatted <br />portion of Elk River in an agricultural zone which does permit unlimited keeping of <br />livestock. <br /> <br />Planning Commission representative Mr. Jim Trape indicated that building was already <br />built and questioned the possibility of granting a variance if the building had not <br />been constructed prior to the variance request. Commissioner Tralle also suggested the <br />possibility of an additional fee for a building permit after the building was built. <br /> <br />Discussion was carried on regarding the language of the City Administrator's <br />recommendation for the conditions of the variance request. It was suggested that <br />condition number 3 contain the language of livestock and poultry rather than horses. <br /> <br />General discussion was carried on regarding the Omitt's residence. Ms. Rita Hershey, <br />a neighbor, indicated that she did not care what the Omitt's did with their property <br />regarding animals, building and their property in general. Commissioner Tralle <br />questioned the number of vehicles on the Omitt property and the possibility of a home <br />occypation. Mr. Omitt indicated that he had two tow trucks, a semi truck, a van, a <br />motor home and a number of other vehicles on the property. <br /> <br />Discussion was also carried on regarding the number of horses the Omitt's owned. Dis- <br />cussion was carried on regarding the cleanup of the property, the number of animals <br />on the property, and the fence location on the property. <br /> <br />Councilmember Engstrom indicated that he felt that it was permissable to have a <br />fence up to the edge of the property in the front of the property. <br /> <br />Councilmember Duitsman indicated that he felt six horses could be permitted on the <br />property. <br /> <br />COUNCILMEMBER DUITSMAN MOVED TO APPROVE THE VARIANCE REQUEST BY MR. ANTHONY OMITT TO <br />PERMIT AN ADDITION TO AN EXISTING METAL-SKINNED BUILDING WITH THE FOLLOWING <br />CONDITIONS: 1) THAT AN EXISTING TEMPORARY LEAN-TO ON THE FRONT OF MR. OMITT'S PROPER <br />BE REMOVED, 2) THAT MR.
