RON <br />MARKHAM TO ALLOW THE CONSTRUCTION OF A FUNERAL HOME ON EVANS AVENUE,. WITH THE <br />CONDITIONS AS STATED IN THE CITY ADMINISTRATOR'S MEMO TO THE MAYOR AND CITY COUNCIL <br />DATED JULY 12, 1984 AND THE ADDITIONAL CONDITION THAT THE WATER DRAINAGE NOT HAVE <br />AN ADVERSE IMPACT ON THE NEIGHBORHOOD. COUNCILMEMBER DUITSMAN SECONDED THE MOTION. <br />THE MOTION PASSED 3-1. COUNCILMEMBER SCHULDT OPPOSED. <br /> <br />9. Specht Request for Rezoning - Public Hearing <br /> <br />Counci1member Duitsman indicated that Mr. Erwin Specht of 16330 Highway 10 is re- <br />questing a zone change for a portion of his property located in the southeastern <br />portion of the city on the south side of highway 10. Counci1member Duitsman indicated <br />that Mr. Specht is requesting that 100 feet of his property adjacent to highway 10 <br />be rezoned from A-I agriculture to C-3A highway commercial and further indicated that <br />Mr. Specht has stated that the request for the rezoning is for the sole purpose of <br />allowing billboard display. Councilmember Duitsman further indicated that the Planning <br />Commission reviewed Mr. Specht's request and after considerable discussion voted <br />unanimously to recommend to the City Council that the rezoning request be denied. <br /> <br />Mayor Hinkle indicated that prior to consolidation the property was zoned commercial <br />by the county and when the city adopted their zoning map in 1980 the zone was changed <br />to agricultural. Mayor Hinkle further indicated that billboards are not allowed in an <br />A-I zone. <br /> <br />Mr. Tom Woods representing the historical society and the Kelly .Farm indicated that <br />he was opposed to the rezoning of the property as he felt that it was an unappropriate <br />use for the area and not in keeping with the Kelly Farm. <br /> <br />Mr. Rob VanVa1kenberg indicated that he appreciated the ability to do outdoor adver- <br />tising and felt that the billboards attracted business to the city. <br /> <br />Mr. Jim Tra1le representative of the Planning Commission indicated that the planning <br />commission felt that the rezoning of the Specht property would in essence be a spot <br />zone. Mr. Tra11e further indicated that if the zone change were make the city would <br />have no control regarding the corridor into the city. Mr. Tra11e further indicated <br />that the Planning Commission felt that this particular area was given a great deal of <br />attention during the consideration and creation of the C-3B zone and it was a consenses <br />of the Planning Commission to allow for green space along the corridor into the City of <br />Elk River. <br /> <br />General Discussion was carried on regarding the confusion of the zoning and the fact <br />that the zoning was changed in 1980 during the rezoning of various other sections <br />within the City of Elk River and the adoption of a zoning and land use map for the <br />City. Discussion was also carried on regarding the allowable distance between <br />billboard signs in the commercial zone and the industrial zone. Discussion was also <br />carried on regarding the number of billboards along highway 10 on the south side of <br />the highway. <br /> <br />Further discussion was carried on regarding the ammortization period of billboard <br />signs in a nonconforming use. The City's Building and Zoning Administrator indicated <br />that Mr. Zack Johnson is in the process of drafting a sign ordinance for the City and <br />further indicated that the draft will be completed after the legal background work <br />has been done. <br />
