Zoning Ordinance Amendment Regarding Produce Markets in a C~3A Highway Commercial <br />Zone <br /> <br />The City Administrator indicated that Mr. Larry Wolner has requested that a <br />produce market be a permitted use in a C-3A Highway Commercial zone. The City <br />Administrator indicated that the Planning Commission in reviewing Mr. Wolner's <br />request agreed that a produce market or stand was an appropriate use in a C-3A <br />Highway Commercial District, but felt that the produce market or stand should <br />be a conditional use. The City Administrator indicated that the Planning Commission <br />felt by making produce markets a conditional use, the City would be able to exercise <br />greater control over traffic and appearance of a produce market or stand. The <br />City Administrator indicated that the Planning Commission voted to recommend that the <br />City Council amend the Zoning Ordinance to permit as a conditional use, produce <br />markets in a C~3A Highway Commercial zone. <br /> <br />Mayor Hinkle opened the public hearing. <br /> <br />No one appeared for or in opposition of the zoning ordinance amendment. <br /> <br />Mr. Wolner indicated that it is proposed to build a 40 by 80 foot building on the <br />property next to Broadway Bar and Pizza. <br /> <br />COUNCILMEMBER ENGSTROM MOVED TO ADOPT ORDINANCE 84-6, AN ORDINANCE AMENDING SECTION <br />900.16 - OF THE.CITY'S ZONING ORDINANCE TO ADD PRODUCE MARKET AS A CONDITIONAL <br />USE INC..,.3A. HIGHWAY COMMERCIAL ZONES. COUNCILMEMBER SCHULDT SECONDED THE MOTION. <br />THE MOTION PASSED 4-0. <br /> <br />9~. Watermain Feasibility Study <br /> <br />Mr. Jeff Roos of Consulting Engineers Diversified, presented and discussed a feasibil- <br />ity study for the trunk watermain improvements that would extend from the Elk River <br />Plaza Planned Unit Development to the Barrington Place Planned Unit Development. <br />Mr. Roos indicated that the proposed improvement would consist of a 16-inch watermain <br />extending from Freeport Avenue through the Elk River Plaza Planned Unit Development. <br />Mr.. Roos indicated that the estimated project cost of $76,000. Mr. Roos indicated <br />that the project could be paid for through special assessments and monies from the <br />water utility fund. <br /> <br />Discussion was carried on regarding the easements necessary and the assessing of costs <br />to benefited properties. <br /> <br />The'City Administrator indicated that should the City CounciL have approved the <br />zone change for the Dietz property. the owners would have wiaved their rights for <br />objection to assessments. The City Administrator indicated that the City Council <br />will now have to hold a public hearing before ordering the watermain improvement <br />project. The City Administrator indicated that the City's engineers will request <br />Northdale Construction to submit a bid on the watermain project as a change order <br />to the East Main Street project. <br /> <br />COUNCILMEMBER SCHULDT MOVED TO APPROVE RESOLUTION 84-17, A RESOLUTION ACCEPTING THE <br />FEASIBILITY. REPORT FOR THE TRUNK WATERMAIF IMPROVEMENT THROUGH THE ELK RIVER PLAZA <br />PLANNED UNIT DEVELOPMENT TO THE BARR1NGTONPLACE PLANNED UNIT DEVELOPMENT ,I ORDERING <br />THE PLANS AND SPECIFICATIONS FOR THE PROJECT AND ESTABLISHING JULY 16, 1984 AS A <br />PUBLIC HEAR1NG DATE UNLESS A PETITION BY 100% OF THE PROPERTY molliERS FOR THE IMPROVEMENT <br />IS RECEIVED! BY THE CITY. COUNCILMEMBER GUNKEL SECONDED THE MOTION. THE MOTION PASSED <br />4-0. <br />
