<br /> <br /> <br /> <br />City Council Minutes <br />June 18, 1984 <br />Page Seven <br /> <br /> <br />acres of property in an A-I Agricultural zone that 1S in condition with the <br />family. farm operation. <br /> <br />Mayor Hinkle opened the public hearing. <br /> <br />Mr. Paul Busch indicated that a two-year permit would be sufficient time, as <br />he currently has plans for the construction of a house on the property. <br /> <br />Councilmember Schuldt questioned the extent of Mr. Paul iBusch 's involvement in <br />the family farm operation, as the zoning ordinance states that the mobile home <br />occupants must derive their principal income from the farm operation. Mr. Busch <br />indicated that he does work outside of the family farm operation. <br /> <br />General discussion was carried on regarding the City's zoning ordinance and the <br />conditions that are required to allow for a mobile home as a temporary residence. <br /> <br />COUNCILMEMBER ENGSTROM MOVED TO APPROVE THE CONDITIONAL USE PERMIT REQUESTEDiBY <br />PAUL AND DONNA BUSCH TO PLACE A MOBILE HOME ON TEN ACRES OF PROPERTY ZONED A-I <br />AGRICULTURAL. COUNCILMEMBER GUNKEL SECONDED THE MOTION. THE MOTION FAILED 1-2. <br /> <br />The City Administrator indicated that the City Council could consider a conditional <br />use permit for the mobile home for a six-month period as allowed in the City's <br />Zoning Ordinance. <br /> <br />COUNCILMEMBER ENGSTROM MOVED TO APPROVE A SIX~MONTH CONDITIONAL USE PERMIT DATED <br />AUGUST 1ST FOR A MOBILE HOME TO BE PLACED ON PAUL AND DONNA'BUSCH'SPROPERTY ZONED <br />A-I AGRICULTURAL. COUNCILMEMBER GUNKEL SECONDED THE MOTION. THE . MOTION PASSED <br />3-0. <br /> <br />8. Wuorio Conditional Use Permit/Variance Request - Public Hearing <br /> <br />The City Administrator indicated that Mr. Peter Wuorio of Wuorio Sales at 9619 <br />Highway #10 in Elk River, has requested an ordinance amendment to allow car and <br />truck sales in a C-3B Highway Commercial zone and has requested a variance from <br />the rear yard setback to allow for the construction of abuilding on the property. <br />The City Administrator indicated that during the Planning Commission's discussion <br />of Mr. Wuorio's request, it was determined that the Planning Commission was opposed <br />to any zoning ordinance amendment to permit the use as requested by Mr. Wuorio <br />and further, suggested that Mr. Wuorio remain a nonconforming use and make use <br />of the Zoning Ordinance that permits alterations in nonconforming uses under <br />certain standards. The City Administrator indicated that the Planning Commission <br />unanimous ly recommended that Mr. Wuorio be permitted to make the alterations as <br />requested and recommended that the City Council grant a one-foot setback variance <br />on the rear property line. The City Administrator indicated that the City of <br />Ramsey has submitted a.letter for the file indicating that it is an appropriate <br />use in their City. <br /> <br />Councilmember Gunkel questioned the variance standards and whether they could be <br />met. Mr. Rick Breezee, Building and Zoning Administrator, indicated that the City <br />in their rezoning process, made Wuorio Sales a nonconforming use. <br /> <br />COUNCILMEMBER ENGSTROM MOVED TO APPROVE A ONE-FOOT REAR YARD SETBACK VARIANCE FOR <br />THE PROPERTY AT 9619 HIGHWAY tHo AND TO GRANT A VARIANCE TO MR.WUORIO TO ENABLE <br />HIM TO EXPAND HIS NONCONFORMING USE. COUNCILMEMBER GUNKEL SECONDED THE MOTION. <br />THE MOTION PASSED 3-0. <br />
