Councilmember Gunkel indicated <br />that if it was a creation of five lots, it would not be in conformance with <br />the City's subdivision ordinance. <br /> <br />Discussion was carried on regarding the subdivision of Mr. Lamm's property <br />along County Road #1. <br /> <br />ODUNCILMEMBER ENGSTROM MOVED TO APPROVE THE ADMINISTRATIVE SUBDIVISION REQUEST <br />BY MR. DONALD LAMM OF 21272 ELK LAKE ROAD. CDUNCILMEMBER SCHULDT SECONDED THE <br />MOTION. THE MOTION PASSED 3-0. <br /> <br />11. Amendment to Zoning Ordinance Regarding Funeral Parlor Use - Public Hearing <br /> <br />The City Administrator indicated that the City has recently had requests for <br />information regarding the location of funeral parlors within the City of Elk <br />River. The City Administrator indicated that because the City's Zoning <br />Ordinance does not specif ically address funeral parlors, the City's Building <br />and Zoning Administrator requested a recommendation from Mr. Zack Johnson, the <br />City's Planner. The City Administrator indicated that Mr. Johnson recommended <br />that funeral parlors be allowed as a principal use in C-3A andC-3B zones and <br />that they be allowed as a conditional use in R-3, R-4, and C-4 zones. The <br />City Administrator further indicated that the Planning Commission considered <br />Zack Johnson's recommendation and voted unanimously to recommend that funeral <br />parlors be allowed as a principal use in C-3A and C-3B zones and as a conditional <br />use in R-3, R-4 and C-4 zones. <br /> <br />Councilmember Gunkel indicated that she did not have a problem with funeral par- <br />lors being allowed as a conditional use in an R-3 zone, even though it is a <br />lower density zone, as most funeral homes are designed like homes and could <br />fit into the R-3 setting. <br /> <br />Councilmember Schuldt indicated that he felt a funeral home is a commercial use <br />and should not be allowed in a residential zone. <br /> <br />Councilmember Engstrom indicated that he felt if funeral homes were allowed <br />as a conditional use in residential zones, the City would then be able to set <br />the conditions of the funeral parlor. Councilmember Engstrom further indicated <br />that he felt funeral parlors were much the same as churches and found in res- <br />idential zones; <br /> <br />Discussion was carried on regarding the nonconforming use of the present funeral <br />home in Elk River. <br /> <br />Mr. John Pearce, representative of the Planning Commission, indicated that the <br />Planning Commission felt funeral parlors are found in residential areas and <br />through the conditional use, the City could require off street parking. Mr. <br />Pearce further indicated that he felt a funeral home would not go into an existing <br />development, but that it could be allowed in future residential development. <br /> <br />Mr. Rick Breezee, Building and Zoning Administrator, indicated that a funeral <br />parlor in the downtown area, is not necessarily compatible with the downtown <br />redevelopment. <br />
