<br /> <br /> <br /> <br />City Council Minutes <br />April 16, 1984 <br />Page Four <br /> <br />1) That a maximum of three horses be allowed <br />2) That no other animals be permitted on the property <br />3) That the provisions of the City's nuisance ordinance be specifically <br />applied, and, <br />4) That the permit be reviewed in two years. <br /> <br />Councilmember Engstrom further indicated that the City staff has also recommended <br />that some minimum landscaping be required around the metal-skinned building. <br /> <br />Discussion was carried on regarding the language "no other animal". It was <br />determined that the language should be "that no other livestock or poultry be <br />permitted on the propeity." <br /> <br />Discussion was also carried on regarding the m1n1mum landscaping requirement. <br />The City Administrator indicated that the City would need a site plan to deter- <br />mine where the building was located and that the City's Building and Zoning <br />Administrator could then determine what and how much landscaping would be <br />necessary. <br /> <br />COUNCILMEMBER ENGSTROM MOVED TO APPROVE THE CONDITIONAL USE PERMIT REQUESTED BY <br />MR. GREGORY KNOX TO ALLOW FOR THE CONSTRUCTION OF A METAL-SKINNED AGRICULTURAL <br />POLE BUILDING IN GREENHEAD ACRES 2ND ADDITION, WITH THE FOUR CONDITIONS AS STATED <br />IN THE CITY ADMINISTRATOR'S MEMO TO THE MAYOR AND CITY COUNCIL, DATED APRIL 12, <br />1984. COUNCILMEMBER SCHULDT SECONDED THE MOTION. THE MOTION PASSED 3-0. <br /> <br />9. Denzer Administrative Subdivision and Street Vacation Request~ Public Hearing <br /> <br />Councilmember Engstrom indicated that Mr. Gary Denzer of 13425 South Ridge Road <br />in Minnetonka, has requested that the City Council approve an Administrative Sub- <br />division to allow for the consolidation of seven lots into one larger lot and <br />further, to vacate a street easement that divides his property from north to <br />south. <br /> <br />Discussion was carried on regarding the legality of the lots initially created <br />and the fact that Mr. Denzer's request to consolidate the property into one <br />large parcel would be much better for the City of Elk River. <br /> <br />Discussion was also carried on regarding the necessity of a private road agreement <br />for Mr. Denzer to access his property. Discussion was also carried on regarding <br />the street easement. The City Administrator indicated that the easement is not <br />utilized by the City of Elk River and that it does not connect to any other right- <br />of-way currently maintained by the City of Elk River. <br /> <br />COUNCILMEMBER SCHULDT MOVED TO APPROVE THE ADMINISTRATIVE SUBDIVISION REQUEST BY <br />MR. DENZER AND TO VACATE THE STREET EASEMENT THAT BISECTS HIS PROPERTY FROM NORTH <br />TO SOUTH. COUNCILMEMBER GUNKEL SECONDED THE MOTION. THE MOTION PASSED 3-0. <br /> <br />10. Lamm Administrative Subdivision Request - Public Hearing <br /> <br />Councilmember Engstrom indicated that Mr. Donald Lamm of 21272 Elk Lake Road <br />has requested an administrative subdivision to allow four lots, 2~ acres and <br />larger in size, to be split from his existing 105 acre parcel. Councilmember <br />Engstrom indicated that Mr. Lamm's request has been reviewed by the Building <br />and Zoning Administrator and is in conformance with the zoning and subdivision <br />requirements. <br />
