DONALD BRITT FOR THE <br />PROPERTY AT 14061 HIGHWAY 10 FROM AN R-lb/SINGLE FAMILY CLASSIFICATION TO AC-3/ <br />HIGHWAY COMMERCIAL. COUNCILMEMBER SCHULDT SECONDED THE MOTION. THE .MOTION PASSED <br />4-0. <br /> <br />11. Minnesota-Ohio Oil Company Variance Request - Public Hearing <br /> <br />The City Administrator indicated that the Minnesota-Ohio Oil Company has requested <br />a variance from the City's sign Ordinance for the property located at 17345 Highway <br />10, operated as the Fina Gas Station. The City Administrator indicated that the <br />Minnesota-Ohio Oil Company is requesting a variance from the specified height in <br />the City's Sign Ordinance. The City Administrator indicated that the Minnesota- <br />Ohio Oil Company's request in their first alternate is to allow a sign that would <br />be 42 feet in height and would project above the Ordinance requirement by approx- <br />imately 26 feet and that the second requested alternate would allow a sign 22 feet <br />in height and project over the required limit by 6 feet. The City Administrator <br />indicated that the Planning Commission found the variance standards in the City's <br />Zoning Ordinance could not be met in this situation, and unanimously voted to deny <br />the variance. <br /> <br />Mr. Paul Bell of Sneaky Pete's indicated that should Minnesota-Ohio be allowed a <br />larger sign, he would also request a larger sign. Mr. Joe Berglove, owner of the <br />Minnesota-Ohio Oil Company gas station, indicated that they have been in their par- <br />ticular location 11 years, under the name of American Petrofina or Fina. Mr. Berg- <br />love indicated that American Petrofina has moved out of the country and now Minneso- <br />ta-Ohio has developed their own brand name and they want to change the Fina sign to <br />represent the present company's name. <br /> <br />Mr. Chuck Hess, representative of Rochester Ace Triad Sign Company, indicated that <br />they would be using the same sign, just changing the sign face. Mr. Hess indicated <br />that it would cause a hardship to reduce the siz,e and height of the sign because <br />of competition. <br /> <br />Mr. Berglove indicated that they could go to a horizontal sign but if it was within <br />the sign ordinance, it would cause problems for trucks as their building is only 10 <br />feet high and therefore, the sign would only be 16 feet high. <br /> <br />The City Administrator indicated that the requirement of 6 feet above the height of <br />the building is to provide some regularity with the City signs and further indicated <br />that the Best Western and Sneaky Pete's are in conformance with the City sign ord- <br />inance. <br /> <br />Mr. Joe Berglove indicated that they could put a false front on the top of their <br />building in order to make the building higher to allow for the height required for <br />their sign. <br />
