<br /> <br />" <br /> <br />City Council Minutes <br />July 18, 1983 <br />Page Eight <br /> <br />Discussion was carried on regarding the interpretation of the Ordinance with re~ <br />gard to the changing of the face of a sign. The City Administrator indicated <br />that the courts do not view economic reasons as a basis for hardship, and the <br />granting of a variance would establish a precedence. <br /> <br />The City Administrator indicated that if the sign ordinance is a bad ordinance, the <br />City Council should consider changing the ordinance. <br /> <br />Mr. Rob VanValkenberg indicated that all businesses along Highway 10 are competing <br />for the highway business and their number one priority is to compete with the Fina <br />sign for that highway business. <br /> <br />Councilmember Schuldt indicated that he felt the horizontal sign would be more <br />attractive. General discussion was carried on regarding the City Sign Ordinance. <br /> <br />COUNCILMEMBER GUNKEL MOVED TO APPROVE THE VARIANCE REQUEST BY MINNESOTA~OHIO OIL <br />COMPANY FROM THE CITY SIGN ORDINANCE FOR THE PROPERTY LOCATED AT 17345 HIGHWAY 10. <br />COUNCILMEMBER ENGSTROM SECONDED THE MOTION. <br /> <br />Discussion was carried on regarding the findings of the approval of the variance <br />request and the setting of a precedence for variances to the City Sign Ordinance. <br /> <br />The City Administrator indicated that the City Council should consider an amend- <br />ment to the Sign Ordinance rather than the granting of a variance for the Minnesota <br />Ohio Oil Company. Councilmember Schuld indicated that he felt the City was bound <br />to the Sign Ordinance. Mayor Hinkle expressed his agreement with Councilmember <br />Schuldt. <br /> <br />THE MOTION FAILED 0-3. COUNCILMEMBER SCHULDT, GUNKEL AND ENGSTROM OPPOSED. <br /> <br />COUNCILMEMBER ENGSTROM MOVED TO DENY THE VARIANCE REQUEST BY MINNESOTA-OHIO OIL <br />COMPANY FROM THE CITY'S SIGN ORDINANCE FOR THE PROPERTY AT 17345 HIGHWAY 10. COUNCIL- <br />MEMBER SCHULDT SECONDED THE MOTION. THE MOTION PASSED 3-0. <br /> <br />12. Copy Machine Purchase <br /> <br />The City Administrator indicated that the City staff has reviewed variaous copy <br />machines and recommends that the City Council authorize the purchase of a Sharp <br />825 Copy Machine for the City offices. <br /> <br />COUNCILMEMBER GUNKEL MOVED TO APPROVE THE PURCHASE OF A SHARP 825 COPY MACHINE IN <br />THE AMOUNT OF $6,160.00 FOR THE CITY OFFICES. COUNCILMEMBER SCHULDT SECONDED THE <br />MOTION. THE MOTION PASSED 3-0. <br /> <br />13. Ordinance Amending Section 502 of the City Code Regarding Dogs and Other Animals <br /> <br />The City Administrator indicated that Ordinance 83-8 is an ordinance providing <br />an amendment to the City's Code regarding stray dogs and dog licensing.
