The City Administrator indi- <br />cated that the Planning Commission did make a recommendation that the City Staff <br />investig~te changing the entire area in the vicinity of the Cowles~ property from <br />I-I to C-3. The City Administrator indicated that the proposed C-3 zone for the <br />Cowles property and additional properties in the area is inconsistant with the City's <br />land use map because of several deliberate thoughts of the City Council and the <br />Planning Commission regarding the concern of a strip approach to the City of Elk River. <br /> <br />Mayor Hinkle opened the public hearing. <br /> <br />Discussion was carried on regarding a nonalcoholic bar and entertainment center, <br />the type of business it is and what is proposed for that specific business to be <br />located in the George Cowles property. <br /> <br />Mr. Cowles questioned why the property could not be zoned commercial as there were <br />many commercial businesses in the area. The City Administrator indicated that Mr. <br />Cowles buildings are not designed for commercial and should it be rezoned commercial, <br />the present industries would not be conforming. The City Administrator indicated that <br />the rezoning of this specific property would create a spot zone. <br /> <br />Discussion was carried on regarding the rezoning of the total area and the recommenda- <br />tion from the City Planner regarding that study. Mr. Roger Bluhm, representing the <br />nonalcoholic bar and entertainment center business, described his business and further <br />indicated that he had letters from other cities recommending that type of business <br />on a highway location. Mayor Hinkle indicated that it was a land use question~ and <br />rezone question-, rather than a business location question. <br /> <br />Councilmember Gunkel indicated that she felt the type of business proposed for the <br />area was a good idea, but a spot zone could not be done specifically for that bus- <br />iness. Councilmember Schuldt indicated that he felt it was a spot zone and that a <br />commercial spot zone could not be,placed in the middle of light industrial. <br /> <br />COUNCILMEMBER SCHULDT MOVED TO DENY THE ZONE REQUEST BY MR. GEORGE COWLES FOR THE <br />PROPERTY HE OWNS AT 15560 CLEVELAND STREET FROM A CURRENT ZONE OF I-l/LIGHT INDUS- <br />TRIAL TO A C-3/HIGHWAY COMMERCIAL ZONE. COUNCILMEMBER GUNKEL SECONDED THE MOTION. <br />THE MOTION PASSED 4-0. <br /> <br />9. Plude Conditional Use Permit Request ~\Bublic Heaning <br /> <br />The City Administrator indicated that Mr. David Plude of 634 Gates Avenue has re- <br />quested a conditional use permit to have a home occupation. The City Administrator <br />indicated that the home occupation is to allow the operation of a catering service. <br />The City Administrator further indicated that Mr. Plude intends to convert his <br />garage for the use of a catering service if permitted by the City. The City Admin- <br />istrator indicated that the City's concerns are that Mr. Plude will build an addi- <br />tional garage for his vehicle, and that his operation will comply with the necessary <br />state and City Health standards. <br />
