<br /> <br />City Council Minutes <br />June 6, 1983 <br />Page Five <br /> <br />The City Administrator in icated that the City Staff and the Planning Commission <br />have agreed to recommend 0 the City Council that private existing substandard <br />roadways not be accepted r maintained by the City of Elk River. The City <br />Administrator further ind'cated that in new road construction to serve admin- <br />istrative subdivision or here there might be existing lots of record off from <br />a roadway, where a public road can be constructed, all roads should be con- <br />structed to blacktop stan ard. The City Administrator further indicated that <br />in the area of a subdivis'on or specific lot of record, whereby a private road <br />maybe constructed, the Ci y Staff recommends that it may be done with the strictest <br />adherence to the private oad agreement requirement in the City's Subdivision <br />Ordinance. <br /> <br />Councilmember Duitsman qu <br />City Council in the past <br />not located on a public r <br /> <br />stioned the possibility of new private roads, as the <br />as denied building permits because the property is <br />ad. <br /> <br />Mayor Hinkle indicated th t there is the possibility that the best use of a <br />piece of property would b for a residential dwelling and therefore, the City <br />could allow for a private road in such cases. The City Administrator indicated <br />that the Ordinance requir s that the property must have access to a road and <br />that the Private Road Agreement requires that the road be built to a higher <br />standard than just a drive ay which generally people do not want to do. <br /> <br />Discussion was carried on regarding the situation of 2llth whereby a private <br />road continues from a public road. The City Administrator indicated that the <br />Planning Commission reco ends that in all existing substandard roads, they <br />should be upgraded and that the cost be assessed to the owners when no previous <br />road assessment has been paid. The City Administrator indicated that Jarvis <br />Street is an example of th t recommendation. <br /> <br />Discussion was carried on regarding the distinction between maintenance and <br />rebuilding for assessment urposes. <br /> <br /> <br />Counoilmember Duitsman ind'cated that he felt the City Council should hold an <br />information hearing to obt in the public's input regarding this road maintenance <br />issue. The City Administr tor indicated that the Planning Commission felt <br />everyone should pay at lea t once for their road, and that existing substandard <br />private roads should be br ught up to City standards and assessed to the home- <br />owners. The City Administ ator indicated that the Planning Commission also <br />recommended that when a pe ition signed by 51% of the residents for improvements <br />of the roads is received b the City, the City Council should consider that <br />request. <br /> <br />General discussion was car <br />an existing substandard ro <br />public input before a deci <br />the City Council does have <br />Council could review each <br /> <br /> <br />on regarding the assessment of costs to upgrade <br />Mayor Hinkle suggested the City Council obtain <br />is made. Councilmember Gunkel indicated <br />that she was in agreement that all upgraded roads should be paved, but she has <br />some problem with the requirement of a 30 foot road in an outside area of the <br />core City. <br />
