Councilmember Engstrom also indicated his support for half of the <br />Hills area were in agreement for the feasibility study. Mr. Tralle indicated <br />that the feasibility study will give the residents the answers to the actual costs <br />for the improvement of the streets. <br /> <br />General discussion was carried on regarding the assessment of the project and the <br />acceptance of the road improvements by the 40 percent of the residents that did <br />not sign the petition for the feasibility study. The City Administrator indicated <br />that the City must prove beiefit before a property can be assessed. <br /> <br />Mr. Jeff Roos of Consulting Engineers Diversified, indicated that the residents <br />should work with the City in a cooperative spirit in order to alleviate condemna- <br />tion, if right-of-way is required. <br /> <br />COUNCILMEMBER DUITSMAN MOVED TO ADOPT RESOLUTION 83~15, A RESOLUTION AUTHORIZING <br />THE CITY ENGINEER TO PROCEED WITH THE FEASIBILITY STUDY FOR THE HEAVENLY HILLS <br />ADDITION AND TO CALL FOR A PUBLIC HEARING DAtE TO BE SET FOR MAY i6, i983.u. COUNCIL- <br />MEMBER ENGSTROM SECONDED THE MOTION. THE MOTION PASSED 4-0. <br /> <br />COUNCILMEMBER DUITSMAN MOVED TO APPROVE THAT ONE-HALF OF THE COST OF THE FEASIBILITY <br />STUDY WILL BE PAID BY THE CITY OF ELK RIVER. COUNCILMEMBER ENGSTROM SECONDED THE <br />MOTION. THE MOTION PASSED 4-0. <br /> <br />11. HRA Appointment <br />The City Administrator indicated that Mayor Hinkle's term on the City's Housing <br />and Redevelopment Authority has expired and further indicated that Mayor Hinkle <br />does desire to be re-appointed to the Housing and Redevelopment Authority. <br /> <br />COUNCILMEMBER DUITSMAN MOVED TO APPOINT MAYOR HINKLE TO THE HOUSING AND REDEVELOP- <br />MENT AUTHORITY FOR A FIVE-YEAR TERM. COUNCILMEMBER SCHULDT SECONDED THE MOTION. <br />THE MOTION PASSED 4-0. <br /> <br />l1Yz. Mechanical Amusement Device License Application- Sneaky Pete's <br /> <br />COUNCILMEMBER ENGSTROM MOVED TO APPROVE A MECHANICAL AMUSEMENT DEVICE LICENSE FOR <br />TWO VIDEO GAMES AT SNEAKY PETE'S FAMILY RESTAURANT. COUNCILMEMBER DUITSMAN SECONDED <br />THlE.MOTION. THE MOTION PASSED 4-0. <br /> <br />13. Administrator's Update <br /> <br />A. Fire Code <br /> <br />The City Administrator indicated that the Fire Department is concerned with the <br />ability to enforce the Uniform Fire Code and has therefore, recommended that <br />the City Council not adopt the code at this time. The City Administrator <br />further indicated that the Fire Department can consult the State Fire Marshal <br />
