Cowles Private Road Easement Agreement <br /> <br />Mayor Hinkle indicated that Ron Black representing Mr. George Cowles and Mrs. <br />Cowles was present to discuss the Cowles private road easement agreement for <br />property owned by Mr. & Mrs. Cowles on Cleveland Street in the City of Elk River. <br />Mr. Ron Black reviewed the chronology of the events leading up to the private <br />road agreement. Mr. Black indicated that Mr. Cowles was under the impression <br />that his property had been subdivided by the City Council's action at the <br />November 19, 1984 City Council Meeting when the City Council approved the Cowles <br />administrative subdivision request. Mr. Black indicated that in December, Mr. <br />Cowles received a private road agreement to be signed and submitted to the City. <br />Mr. Black further indicated that at the time of the sale of the property and <br />registering of the mortgage, it was determined that the administrative subdivision <br />had not been filed due to the lack of a private road agreement. <br /> <br />Discussion was carried on between the City Council, Mr. Ron Black and Mr. George <br />Cowles regarding the deed of a private road agreement. <br /> <br />Discussion was also carried on regarding the easements of the three properties <br />involved in the administrative subdivision. <br /> <br />Review of the subdivision of the property, the easements and the subdivision were <br />discussed at length between Mr. Ron Black and the City Council. <br /> <br />It was the consensus of the City Council to request the City's Attorney to review <br />the need of a private road agreement and to make a recommendation to the City <br />Council. <br /> <br />Further discussion was carried on regarding the liability of the legal fees. <br /> <br />COUNCILMEMBER WILLIAMS MOVED TO AUTHORIZE THE CITY TO PAY UP TO $150.00 FOR LEGAL <br />COSTS CONCERNING THE COWLES PRIVATE ROAD AGREEMENT AND ADDITIONAL COSTS ABOVE THE <br />$150.00 SHALL BE BILLED TO THE COWLES'. COUNCILMEMBER GUNKEL SECONDED THE MOTION. <br />THE MOTION PASSED 4-0. <br /> <br />4. Consider Designation of Acting City Clerk <br /> <br />Mayor Hinkle indicated that the City Council must designate an Acting City Clerk <br />in the absence of a City Clerk. <br /> <br />COUNCILMEMBER SCHULDT MOVED TO AUTHORIZE MR. ORVIL JOHNSON TO ACT AS CITY CLERK <br />AND, THEREFORE, SIGN CHECKS AND DOCUMENTS AS REQUIRED. COUNCILMEMBER GUNKEL <br />SECONDED THE MOTION. THE MOTION PASSED 4-0. <br /> <br />5. Miscelleneous Items <br /> <br />A. A memorandum from the Liquor Store Manager regarding legislation authorizing <br />wine to be sold in grocery stores. <br /> <br />COUNCILMEMBER SCHULDT MOVED TO ADOPT RESOLUTION 85-7. A RESOLUTION STATING <br />THE CITY OF ELK RIVERS' OPPOSITION TO THE SALE OF WINE IN. GROCERY STORES. <br />COUNCILMEMBER GUNKEL SECONDED THE MOTION. THE MOTION PASSED 4-0. <br />
