City Council shall make its decision on the <br /> • preliminary plat within one hundred twenty (120) days <br /> following receipt by the City of the properly <br /> completed application, unless the subdivider consents <br /> on the record to a continuance. The City Council may: <br /> (1) Grant approval of the preliminary plat, <br /> with or without modification or conditions; or <br /> (2) Refer the preliminary plat to the Planning <br /> Commission or appropriate City staff, officers or <br /> departments for further investigation; or <br /> (3) Deny preliminary plat approval . If the <br /> plat is denied, the City Council shall state the <br /> reasons for denial on the record. <br /> x. Following preliminary plat approval, the <br /> subdivider may petition the Council for installation <br /> of the streets and other public improvements required <br /> for development of the subdivision. The petition <br /> shall be in the form required by the City and shall be <br /> submitted with a cash escrow in the amount of the cost <br /> of the feasibility study for the improvements, as <br /> • estimated by the City Engineer. Once the petition and <br /> escrow have been received, the Council may order the <br /> feasibility report. <br /> C. Final Plat <br /> i . Following approval of the preliminary plat, the <br /> subdivider may file an application for approval of a <br /> final plat for all or a portion of the preliminary <br /> plat . The application shall be on a form required by <br /> the City and shall be accompanied by five (5) copies <br /> of the final plat prepared by a land surveyor duly <br /> registered in the State. Failure of the subdivider to <br /> submit the final plat within one (1) year, unless a <br /> written request for extension has been submitted and <br /> for good cause granted by the Council, shall cause the <br /> preliminary plat to become null and void. However, <br /> the subdivider may continue to final plat a "phase" of <br /> the approved preliminary plat within one year of each <br /> phase in order to extend valid approval of the <br /> preliminary plat . If all of the phases of the <br /> approved preliminary plat are not finalized within a <br /> three year period from the date of Council approval, <br /> III the preliminary plat will become null and void unless <br /> the subdivider requests an extension. <br /> 10.22 <br />
