The subdivider or a duly authorized <br /> representative shall attend the Planning Commission <br /> meetings at which the proposal is scheduled for <br /> consideration. <br /> viii . At the public hearing, all persons interested in <br /> the proposed subdivision shall be heard and the <br /> Planning Commission shall either approve, modify and <br /> approve, or disapprove the preliminary plat, and <br /> submit to the council, its findings and <br /> recommendations. The subdivision application shall be <br /> preliminary approved or disapproved by the City <br /> Council within 120 days following delivery of an <br /> application completed in accordance with the City <br /> requirements . The applicant may agree to or request <br /> an extension of the review period. Failure to act <br /> within the one hundred-twenty (120) day period shall <br /> deem approval of preliminary plat . <br /> ix. At this time, the subdivider shall petition the <br /> • Council for installation of the required improvements . <br /> The Council may order a feasibility report and the <br /> subdivider will escrow for the estimated cost of such <br /> a report, as estimated by the City Engineer. <br /> 3 . Final Plat <br /> i . The subdivider within one (1) year after the <br /> approval of the preliminary plat shall file, with the <br /> Planning Department, five (5) copies of the final plat <br /> prepared by a land surveyor duly registered in the <br /> State. Failure of the subdivider to submit the final <br /> plat within one (1) year, unless a written request for <br /> extension has been submitted and for good cause <br /> granted by the Council, shall cause the preliminary <br /> plat to become null and void. However, the subdivider <br /> may continue to final plat a "phase" of the approved <br /> preliminary plat within one year of each phase in <br /> order to extend valid approval of the preliminary <br /> plat .
