According to the revised
layout it will not be necessary for UPA to relocate its transmission line. There will,
however, be construction activity and development within UPA's easement. These
activities include two ponds and a modest encroachment of at Ieast one of the buildings.
Elk River Municipal Utilities (ERMIJ) has distribution facilities underbuilt on UPA's
structures. Should grading or the construction of the ponds or buildings necessitate any
modification to UPA's or ERMU's facilities the developer, through John Bogart of
John Oliver & Associates, has assured us our modification expenses would be
reimbursed. Accordingly, UPA does not object to part of its easement area being
utilized for development such as the proposed ponds, buildings and parking area.
Sincerely,
UNITED POWER ASSOCIATION
•
J.
