COUNCILMEMBER GUNKEL SECONDED THE MOTION. <br />THE MOTION PASSED 4-0. <br /> <br />COUNCILMEMBER GUNKEL MOVED TO APPROVE THE 25 FOOT VARIANCE TO THE 100 <br />FOOT SETBACK REQUIREMENT WITH THE STIPULATION THAT DNR APPROVAL BE <br />ACQUIRED AND THE BERM BEING LEFT AS IT IS SO AS TO PROTECT THE <br />SURROUNDING NEIGHBORS. COUNCILMEMBER TRALLE SECONDED THE MOTION. THE <br />MOTION PASSED 4-0. <br /> <br />e <br /> <br />Hr. It was the <br />Mr. Carson contact Bill Harju of the <br />Conservation District regarding the <br /> <br />The Building and Zoning Administrator indicated that the private road <br />agreement form on file at the City will have to be reworded by the City <br />Attorney to meet the situation of Mr. Carson's lot. He further stated <br />this should be done at the cost of Mr. Carson. <br /> <br />13. Consider Conditional Use Permit for Sipes Service/Public Hearing <br /> <br />Commissioner Wilson, Planning Commission representative, stated that <br />Mr. Sipes is requesting a conditional use permit to allow his existing <br />gas station to become a conditional use. Mr. Wilson explained that the <br />gas station was a non-conforming use, (grandfathered in) but due to a <br />recent ordinance amendment, it could become a conditional use. Mr. <br />Wilson also stated that Mr. Sipe is requesting that he be allowed to <br />construct a 46 by 32 foot canopy over his gas pumps. Commissioner Wilson <br />stated that the Planning Commission recommended approval of the request <br />to allow the gas station as a conditional use, and further approved the <br />canopy and two additional signs on the canopy. <br /> <br />e <br /> <br />Mayor Hinkle opened the public hearing. No one appeared for or against <br />the matter. Mayor Hinkle closed the public hearing. <br /> <br />Councilmember Tralle questioned the size of the signs. Mr. Sipe stated <br />the signs would be the size of the canopy facade. <br />
