COUNCILMEMBER GUNKEL SECONDED THE MOTION. THE MOTION PASSED 4-0. COUNCILMEMBER GUNKEL MOVED TO APPROVE THE 25 FOOT VARIANCE TO THE 100 FOOT SETBACK REQUIREMENT WITH THE STIPULATION THAT DNR APPROVAL BE ACQUIRED AND THE BERM BEING LEFT AS IT IS SO AS TO PROTECT THE SURROUNDING NEIGHBORS. Consider Conditional Use Permit for Sipes Service/Public Hearing Commissioner Wilson, Planning Commission representative, stated that Mr. Sipes is requesting a conditional use permit to allow his existing gas station to become a conditional use. Mr. Wilson explained that the gas station was a non-conforming use, (grandfathered in) but due to a recent ordinance amendment, it could become a conditional use. Mr. Wilson also stated that Mr. Sipe is requesting that he be allowed to construct a 46 by 32 foot canopy over his gas pumps. Commissioner Wilson stated that the Planning Commission recommended approval of the request to allow the gas station as a conditional use, and further approved the canopy and two additional signs on the canopy. e Mayor Hinkle opened the public hearing. No one appeared for or against the matter. Mayor Hinkle closed the public hearing. Councilmember Tralle questioned the size of the signs. Mr. Sipe stated the signs would be the size of the canopy facade.
