ONE YEAR REVIEW OF THE CONDITIONAL USE PERMIT. <br />2. THE CANOPY BE NO HIGHER THAN THE BUILDING BUT NOT LESS THAN 12 FEET <br />HIGH. <br />3. '!WO ADDITIONAL PHILLIP 66 SIGNS BE ADDED TO THE CANOPY. <br />4. PARKING ACCEPTED AS IS. <br />5. INGRESS AND EGRESS BE ACCEPTED AS IS. <br /> <br />COUNCILMEMBER TRALLE SECONDED THE MOTION. THE MOTION PASSED 4-0. <br /> <br />Councilmember Gunkel stated her concern regarding the parking on the <br />sidewalk. Mr. Sipe indicated he had corrected the problem. <br /> <br />14. Consider Conditional Use Permit Request by Barthel Construction <br />Public Hearing <br /> <br />Mr. Ken Barthel stated that Barthel Construction is requesting to amend <br />the Elk River Plaza Planned Unit Development Agreement which speaks to <br />Lot 3. Block 1 Elk River Plaza 2nd Addition. He stated that at the <br />present. 60 units of multi-family housing is in the agreement and they <br />would like to change this to either an office building or office/retail <br />~ building. <br /> <br />Mayor Hinkle opened the public hearing. <br /> <br />The Building and Zoning Administrator informed the Council that the <br />Planning Commission did not see the site plan. <br /> <br />There being no comments from the floor. Mayor Hinkle closed the public <br />hearing. <br /> <br />Councilmember Tralle questioned <br />this new plan would take away <br />Barthel indicated there were two <br />present time which leaves only two <br /> <br />the vacancies in the mall and whether <br />from businesses filling the mall. Mr. <br />spaces being leased in the mall at the <br />more openings. <br /> <br />Councilmember Tralle also questioned whether this would prohibit the <br />expansion of the mall to the Pamida store. Mr. Barthel stated the plans <br />were still to expand the mall to the Pamida store. <br /> <br />Councilmember Gunkel stated she was in favor of the proposal because she <br />felt by adding another 60 units of housing to the area there would be too <br />many people for the area. <br /> <br />e <br /> <br />COUNCILMEMBER ENGSTROM MOVED TO APPROVE THE CONDITIONAL USE PERMIT TO <br />AMEND THE ELK RIVER PLAZA PUD AGREEMENT TO ELIMINATE THE 60 UNITS OF <br />MULTI FAMILY HOUSING PREVIOUSLY APPROVED FOR LOT 3, BLOCK 1, ELK RIVER <br />PLAZA 2ND ADDITON, AND TO ALLOW A MAXIMUM OF 16,000 SQUARE FEET OF <br />SINGLE STORY OFFICE/RETAIL SPACE WITH 20% GREEN AREA WITH THE FOLLOWING <br />USES RESTRICTED FROM THE OPERATION AT THE SITE: <br />
