COUNCILMEMBER GUNKEL SECONDED <br />THE MOTION. THE MOTION PASSED 4-0. <br /> <br />10. Variance Request by Gerald Smith/Public Hearing <br /> <br />The Building and Zoning Administrator indicated that the staff is <br />recommending that this variance be cancelled and noted that Mr. Smith is <br />aware of this recommendation. <br /> <br />Mayor Hinkle opened the public hearing. No one appeared for or against <br />the matter. Mayor Hinkle closed the public hearing. <br /> <br />11. Final Plat Review for M-Vale <br /> <br />The Building and Zoning Administrator indicated this item would be tabled <br />due to the lack of information provided to the staff and Council. <br /> <br />COUNCILMEMBER <br />FOR M-VALE. <br />PASSED 4-0. <br /> <br />TRALLE MOVED TO TABLE THE CONSIDERATION OF THE FINAL PLAT <br />COUNCILMEMBER ENGSTROM SECONDED THE MOTION. THE MOTION <br /> <br />e <br /> <br />12. Variance Request by Chateau Construction/Public Hearing <br /> <br />Stuart Wilson. Planning Commission representative. stated that Richard <br />Carson is planning to build a house on a lot on the Mississippi River. <br />Mr. Wilson explained that a house on this proposed lot is required by the <br />City's Zoning Ordinance. to have the first floor elevation at 859.3 <br />feet above sea level. He further noted that the ordinance allows the <br />access to a residence to be one foot below the 100 year flood elevation. <br />The Ordinance further states. residences that do not have access at <br />or above an elevation not more than one foot below the regulatory flood <br />protection elevation shall not be permitted unless granted a variance. <br />The western end of the proposed access to this property is at 853 feet <br />which is 6 feet below the 100 year flood elevation. <br /> <br />Planning Commissioner Representative Wilson stated that the Planning <br />Commission recommended approval of the variance with the stipulation that <br />a private road agreement be entered into with Mr. Carson for the road <br />access to his property which would t~ke away the liability from the City <br />for not being able to access this property in case of an emergency. <br /> <br />Staff also recommended approval of this variance because of the hardship <br />that bringing the road to the proper height would create for the existing <br />house on that road. <br /> <br />Mr. Wilson stated that this item also requires a variance from the 100 <br />foot setback requirement from the Mississippi River ordinary high water <br /> <br />e <br />
