INNFirffil Planning Commission Minutes Page 6 <br /> March 22, 1994 <br /> • Chairman Tveite opened the public hearing. <br /> Jerry Gallati, 18738 Queen Street, Elk River, stated he is upset by the rezoning <br /> request due to the costs involved. He is opposed to the rezoning. He also <br /> commented on the need for the services provided by Custom Motors. <br /> Sandra Roy, 28008-152nd Street, Elk River, is opposed to the rezoning. Mr. and Mrs. <br /> Roy own Custom Motors and this rezoning and relocation will be economically <br /> devastating for them. <br /> Mike Boelter, 600 Highway 10, Elk River, is also opposed to the rezoning request. <br /> Mr. Boelter stated that in addition to a convenient location for his business, <br /> relocating (due to the proposed rezoning request) could increase his time to <br /> respond to the requests from the Elk River City Police and the Sherburne County <br /> Sheriff's Office. <br /> Tom Driessen, 324 Main Street, Elk River, stated that if the proposed rezoning is <br /> financially devastating for Custom Motors, the City should not approve the <br /> rezoning. <br /> There being no further comments from the public, Chairman Tveite closed the <br /> public hearing. <br /> Chairman Tveite asked Mr. & Mrs. Roy if they have located any alternative sites. <br /> • Mr. & Mrs. Roy responded they have not. <br /> Commissioner Kreger stated that he does agree with staff regarding the rezoning <br /> request, however, he feels Mr. & Mrs. Roy should receive some assistance from the <br /> City. Commissioner Kreger stated he would like to table this request to the next <br /> Planning Commission meeting and directed staff to research possible assistance <br /> measures. <br /> Commissioner Eberley agreed with Commissioner Kreger and requested "current" <br /> legal comments, an EDA proposal, a relocation plan for Custom Motors, and <br /> information from any other sources available to staff before making a decision <br /> regarding this request. <br /> COMMISSIONER KREGER MOVED TO TABLE THE REZONING REQUEST BY THE CITY OF <br /> ELK RIVER, CASE NO. ZC 94-02, TO THE APRIL PLANNING COMMISSION MEETING <br /> PENDING RESEARCH BY STAFF. COMMISSIONER MINTON SECONDED THE MOTION. <br /> THE MOTION CARRIED 6-0. <br /> Due to the possibility of a perceived conflict of interest, Commissioner Eberley stated that <br /> she would refrain from discussion and voting on Agenda Item 10 and removed herself <br /> from the table. <br /> 10. Consider a Conditional Use Permit Request by James Thompson, Public Hearing, <br /> Case No. CU 94-04 <br /> • Staff report presented by Gary Schmitz.
