Planning Commission Minutes nwiloyED Page 7 <br /> March 22, 1994 <br /> • Chairman Tveite opened the public hearing. <br /> Ed Shimek, 9974 Highway 10, Elk River, stated that he is not opposed to the <br /> request however, he would like to see large vehicles moved to the back of the <br /> site due to possible visibility problems for Mr. Shimek's business. <br /> James Thompson, 9975 Highway 10, Elk River, expressed a willingness to work with <br /> Mr. Shimek and agreed to keep high profile vehicles in toward the back of his site. <br /> There being no further comments from the public, Chairman Tveite closed the <br /> public hearing. <br /> COMMISSIONER KREGER MOVED TO RECOMMEND APPROVAL OF THE <br /> CONDITIONAL USE PERMIT REQUEST TO OPERATE A SALES LOT AND CONSIGNMENT <br /> SALES BY JAMES THOMPSON, PUBLIC HEARING, CASE NO. CU 94-04, CITING STAFF'S <br /> MEMO AS FINDING OF FACT. THE REQUEST MEETS THE SEVEN STANDARDS FOR <br /> GRANTING A CONDITIONAL USE PERMIT AND IS CONSISTENT WITH THE <br /> COMPREHENSIVE PLAN. APPROVAL IS RECOMMENDED WITH THE FOLLOWING <br /> CONDITIONS: <br /> 1. THE ENTIRE PARKING AND DISPLAY AREA BE OVERLAYED WITH A BITUMINOUS <br /> SURFACE AND STRIPED. <br /> 2. NO DISPLAY OF VEHICLES BE ALLOWED ON LANDSCAPED AREAS. <br /> • 3. THE TRASH RECEPTACLE ON THE SITE BE SCREENED WITH MATERIALS COMPATIBLE <br /> WITH THE FRONT SIDE OF THE BUILDING. <br /> 4. DISTURBED AREAS NOT DEVOTED FOR BUILDING, PARKING, OR DRIVE BE <br /> LANDSCAPED WITH AT LEAST SOD TO MINIMIZE EROSION. <br /> 5. NO REPAIR OF VEHICLES BE ALLOWED EXCEPT MINOR WORK ON VEHICLES OWNED <br /> BY THE BUSINESS. <br /> 6. THE ENTRANCE FROM HIGHWAY 10 BE WIDENED TO 24 FEET IN WIDTH TO <br /> ACCOMMODATE TWO WAY TRAFFIC AND A PERMIT FROM MNDOT BE OBTAINED, IF <br /> NECESSARY, FOR WORK CONDUCTED IN HIGHWAY RIGHT-OF-WAY. <br /> 7. A DRAINAGE PLAN APPROVED BY STAFF BE SUBMITTED PRIOR TO THE CITY COUNCIL <br /> MEETING. <br /> 8. HIGH PROFILE VEHICLES BE KEPT AT THE REAR OF THE SITE SO AS NOT TO BLOCK <br /> VISIBILITY OF SURROUNDING BUSINESS OWNERS. <br /> COMMISSIONER TACHENY SECONDED THE MOTION. THE MOTION CARRIED 5-0. <br /> 11. Consider a Conditional Use Permit Reguest by James Rossman, Public Hearing, <br /> Case No. CU 94-06 <br /> Staff report presented by Gary Schmitz. The applicant, James Rossman, <br /> • requested a conditional use permit for a zero lot line development for a shared 24 <br /> foot wide driveway. Mr. Rossman is requesting an administrative subdivision to <br /> pc3-22.minutcs <br />
