FURTHER, MPCA <br /> NOISE LEVELS MUST BE ADHERED TO AT ALL TIMES DURING THE OPERATION OF THIS <br /> PLANT. <br /> 11. THE BAGHOUSE FILTER IS TESTED ONCE PER MONTH FOR LEAKS AND THE RESULTS <br /> OF THOSE TESTS ARE COPIED TO THE CITY. <br /> 12. THIS CONDITIONAL USE PERMIT BE REVIEWED IN ONE YEAR AND A NEW PERMIT <br /> BE OBTAINED AT THAT TIME. <br /> 13. STOCKPILES OF RECYCLABLE MATERIALS NOT BE PLACED IN SURFACE WATER <br /> AND THAT RUN-OFF FROM THESE STOCKPILES IS DIRECTED AWAY FROM ANY <br /> SURFACE WATER. THE SIZE FOR THE STOCKPILES BE LIMITED TO THE AMOUNT OF <br /> MATERIAL THAT COULD POSSIBLE BE USED IN ONE YEAR, NOT NECESSARILY TO WHAT <br /> WILL BE USED IN ANY ONE GIVEN YEAR. FURTHER, THE CITY UNDERSTANDS THAT WITH <br /> THIS CONDITION, SOME RECYCLABLE MATERIALS WILL BE RETAINED OVER THE <br /> WINTER SO RECYCLING CAN START AT THE SAME TIME AS SPRINT START-UP FOR THE <br /> ASPHALT PLANT. <br /> 14. COMMERCIAL ASPHALT CONTINUE TO WORK WITH CITY STAFF TO RESOLVE <br /> PROBLEMS WITH ODOR AND NOISE. <br /> 15. AT STAFF'S DISCRETION, COMMERCIAL ASPHALT IMPLEMENT PART OR ALL OF THE <br /> ACTIONS IDENTIFIED BY STAFF TO ELIMINATE SEDIMENT FROM BEING INTRODUCED TO <br /> THE POND ON THE EAST SIDE OF HIGHWAY 169. <br /> • <br /> 16. COMMERCIAL ASPHALT SHALL REDUCE ODOR FROM THEIR PLANT TO <br /> ACCEPTABLE LEVELS BY MODIFYING THEIR OPERATIONAL PROCEDURES OR PLANT <br /> EQUIPMENT. THE ELK RIVER PLANNING COMMISSION WILL REVIEW THE ODOR ISSUE <br /> AGAIN IN JUNE, 1994. <br /> COMMISSIONER MINTON SECONDED THE MOTION. THE MOTION CARRIED 5-0. <br /> Mr. Rohlf asked the Planning Commission to consider Agenda Item No. 9 next. <br /> The Planning Commission agreed. <br /> 9, t, date of Issues Related to Custom Motors <br /> Staff report presented by Steve Rohlf. Mr. Rohlf updated the Planning <br /> Commission on the status of screening and environmental clean-up at the <br /> Custom Motors site. Staff recommended no screening if Custom Motors is <br /> rezoned to single family residential and is required to relocate, and no <br /> environmental clean-up until after the relocation takes place (if in 5 years or less). <br /> Staff indicated their recommendation would change on these issues if the <br /> Custom Motors site is not rezoned and they are not required to relocate. The <br /> Planning Commission concurred with staff. <br /> 8. Consider a Rezoning Request by the City of Elk River, Public Hearing, Case No. ZC <br /> 94-02 <br /> • Staff report presented by Steve Ach. The City is requesting a rezoning of <br /> approximately 15 acres from Il (Light Industrial) to Rib (Single Family Residential). <br /> pc3-22.minutes <br />
