Variance Request by Craig Willey/Public Hearing <br /> <br />Mayor Gunkel noted that Craig Willey is proposing an office building on <br />Lots 1 and 2. Block 15. Village of Elk River and that he is requesting a <br />variance of a 10 foot encroachment on the 10 foot setback requirement <br />which would allow the parking lot to abut the east residential property <br />line. <br /> <br />The Building and Zoning Administrator stated that the Planning Commission <br />voted 6-0 in favor of the request. He further stated this was the best <br />use for the area to gain the required parking. <br /> <br />Mayor Gunkel opened the public hearing. <br /> <br />Don Dreissen stated his opposition to the request. <br /> <br />There being no further comments. Mayor Gunkel closed the public hearing. <br /> <br />Councilmember Tralle suggested that the parking lot be paved and striped <br />and also that an "Enter Only" sign be placed on Main Street. <br /> <br />e <br /> <br />Discussion pursued regarding the number of parking spaces to fit the <br />building. The Building and Zoning Administrator stated that the number <br />of parking spaces does meet code requirements. <br /> <br />COUNCILMEMBER TRALLE MOVED TO APPROVE THE VARIANCE REQUESTED BY CRAIG <br />WILLEY FOR A 10 FOOT ENCROACHMENT ON THE 10 FOOT SETBACK REQUIREMENT <br />FROM THE PARKING LOT TO THE ADJOINING RESIDENTIAL PROPERTY, WITH THE <br />FOLLOWING STIPULATIONS: <br /> <br />1. THAT A 6 FOOT HIGH OPAQUE FENCE RUN ALONG THE EAST PROPERTY LINE TO <br />WITHIN 15 FEET OF THE NORTHtPROPRTY-1LlNE. <br /> <br />2. THAT INGRESS AND EGRESS SIGNS BE POSTED AND ARROWS BE PUT ON THE <br />PAVEMENT. <br /> <br />3. THAT THE SOUTH DRIVE BE POSTED FIRE LANE AND MARKED NO PARKING. <br /> <br />MAYOR GUNKEL SECONDED THE MOTION. THE MOTION CARRIED 4-1. COUNCILMEMBER <br />SCHULDT VOTED NAY. <br /> <br />5.4. & 5.5. Consideration of Variance and <br />Merrill Kampa/Public Hearing <br /> <br />Administrative <br /> <br />Subdivision/ <br /> <br />e <br /> <br />Mayor Gunkel explained the Mr. Kampa is requesting a variance which would <br />allow a 99 foot encroachment on the 200 foot frontage requirement for a <br />lot in an A-1 zone. and also an administrative subdivision to divide a 10 <br />acre parcel from an approximate 33.9 acre parcel of property. She <br />explained that the situation was created from a long term agreement in <br />which the lot was actually sold to his son but never recorded. <br /> <br />The Building and Zoning Administrator stated that Mr. Kampa met the <br />requirements for a variance for the following reasons: <br />
