When the 10 acre parcel was sold to his son. but not recorded. it was <br />done in keeping with County requirements at the time. <br /> <br />2. The property was split under one set of rules and now they are <br />dealing with a new set of rules. which creates a hardship. This is <br />true in spite of the fact that local government constantly changes <br />rules and regulation for the improvement of the community. <br /> <br />3. If the variance were not granted. the 13 acre parcel in between the <br />10 acre lot and Mr. Kampa's lot could not be subdivided in the <br />future. <br /> <br />Mayor Gunkel opened the public hearing. <br /> <br />There being no one for or against the request. Mayor Gunkel closed the <br />public hearing. <br /> <br />COUNCILMEMBER TRALLE MOVED TO APPROVE THE VARIANCE REQUESTED BY MR. KAMPA <br />WHICH WOULD ALLOW A 99 FOOT ENCROACHMENT ON THE 200 FOOT FRONTAGE <br />REQUIREMENT ON PROPERTY LOCATED IN THE SW 1/ 4 OF THE NE 1/4 OF SECTION <br />18, TOWNSHIP 33, RANGE 26, SHERBURNE COUNTY. MINNESOTA. COUNCILMEMBER <br />DOBEL SECONDED THE MOTION. THE MOTION CARRIED 5-0. <br /> <br />e <br /> <br />COUNCILMEMBER TRALLE MOVED APPROVAL OF THE ADMINISTRATIVE SUBDIVISION <br />REQUEST BY MERRILL KAMPA TO SPLIT A 10 ACRE LOT FROM A 33.9 ACRE PARCEL <br />IN AN A-1 AREA WITH THE STIPULATION THAT $200 PARK DEDICATION FEE BE PAID <br />TO THE CITY AND THAT A LEGAL DESCRIPTION OF THE TWO NEWLY CREATED LOTS BE <br />SUPPLIED TO THE CITY FOR RECORDING PURPOSES. COUNCILMEMBER DOBEL <br />SECONDED THE MOTION. <br /> <br />The Building and Zoning Administrator explained that the actual lot split <br />took place prior to park dedication fees being required and. therefore. <br />Mr. Kampa did not feel he should pay the fee. <br /> <br />Mayor Gunkel indicated that due to a similar situation. and the <br />possibility of setting a precedent. the fee should be paid. <br /> <br />THE MOTION CARRIED 5-0. <br /> <br />5.6. & 5.7. Consideration of Preliminary and Final Plat Reviews of Replats <br />#6 and #8. of Barrington Place PUD/Public Hearing <br /> <br />Mayor Gunkel <br />Development <br /> <br />introduced these items to the Council and explained M & S <br />are no longer interested in replating at the present time. <br /> <br />Mayor Gunkel opened the public hearing for both Replats #6 and #8. There <br />being no one present for either item. Mayor Gunkel closed the public <br />hearing. <br /> <br />e <br /> <br />COUNCILMEMBER DOBEL MOVED TO TABLE ANY ACTION ON BOTH ITEMS 5.6 AND 5.7 <br />INDEFlNETELY. COUNCILMEMBER HOLMGREN SECONDED THE MOTION. THE MOTION <br />CARRIED 5-0. <br />
