<br />Page 5 <br /> <br />City Council Minutes <br />June 29. 1987 <br /> <br />e <br /> <br />Discussion was held regarding the softball field at Orono Park and <br />whether or not it would be feasible to move the lights from that field to <br />the softball complex. Councilmember Holmgren indicated that the softball <br />field at Orono Park would best be used by families using the park for <br />picnic activities and that the lights would best be utilized by the <br />softball leagues. <br /> <br />It was the consensus of the Council to delay any decision until Street <br />Superintendent. Phil Hals was present to discuss this with the Council. <br /> <br />13. Landfill Compliance to Solid Waste Ordinance/Discussion <br /> <br />The City <br />requires <br />within <br />that as <br />and has <br /> <br />Administrator indicated that the City's Solid Waste Ordinance <br />solid waste establishments to make application for license <br />120 days after the adoption of the ordinance. Mr. Klaers noted <br />of this date. the Landfill has not made application for a license <br />indicated that they intend to challenge the ordinance. <br /> <br />e <br /> <br />The City Administrator noted that the City Attorney has recommended that <br />City take appropriate administrative action to seek voluntary compliance <br />to the ordinance by sending the Landfill a certified letter. He <br />indicated the City is intending to send this letter. Mr. Klaers stated <br />that if the Landfill chooses to not respond to the letter. the City will <br />go through civil litigation to seek compliance. He indicated that the <br />City is not trying to close down the landfill but to get them to comply <br />to the Ordinance. <br /> <br />Mr. Chris Kreger. owner of the Landfill. questioned why the City had <br />denied a building permit for an office building to be constructed on the <br />Landfill site. The City Administrator indicated that the City has the <br />authority to deny the permit according to Section 900.38-lB of the Elk <br />River City Code. <br /> <br />Mr. Tom Vollbrecht. Attorney for the Landfill stated that this section of <br />the code does not allow the City to deny a building permit according to <br />his interpretation. Mr. Vollbrecht requested that the City send a <br />letter to Mr. Kreger stating that the building permit was denied and the <br />reasons for denial. <br /> <br />The City Administrator indicated that this matter would be put on a <br />future Council Agenda and when the Council makes a decision regarding the <br />building permit. a letter would be sent at this time. <br /> <br />14. <br /> <br />City Owned Property/East 169. North of Elk Hills Drive <br /> <br />e <br /> <br />Mayor Gunkel indicated that the property the City owned on Highway 169 <br />was previously before the Council for zone change and is presently at a <br />standstill until the Growth Management Plan Task Force makes any final <br />decisions. She further indicated that she doubted whether this location <br />was appropriate for a trucking business and felt that an industrial zone <br />would be more appropriate. <br />
