Bob Morton stated that the Planning <br />Commission discussed and heard public comments regarding the CUP for UPA. <br />He noted that the Planning Commission recommendations are included in the <br />draft conditional use permit. <br /> <br />Mayor Gunkel opened the public hearing. <br /> <br />Mr. Al Fisher questioned if the decision of the City Council can stop the <br />RDF Facility from operating in Elk River. <br /> <br />Mr. Ackerman stated there was a viable alternative that incorporates NSP <br /> <br />and UPA on a State-wide basis and walU be better economically. <br />wD~I~ <br /> <br />Marlene Hentges stated that in the process of burning we are creating <br />chemicals that can kill the children. <br /> <br />Vicki Swan spoke on dioxins and lead contaminations. She stated that <br />tests used to determine State levels were inaccurate according to EPA. <br />She further noted that there will be lead in the soil. She urged the <br />Council to vote against the conditional use permit on behalf of the <br />children in the community. <br /> <br />Mr. Bob Swan spoke on lead and dioxins and noted alternatives have not <br />been looked at. <br /> <br />Mr. Dave Briggs stated there was a viable alternative. He noted Mr. Gary <br />Ackerman's process should be studied further. He further stated that <br />people should reduce garbage production. <br /> <br />Jeanne Eggert talked about the pollution affecting the river. She also <br />questioned that since dioxins are so dangerous. how can the Council say <br />they are safe by voting in favor of RDF. <br /> <br />Robert Lowman of Little Falls stated that he feels the people have a lot <br />of unanswered questions and felt these questions should be answered. <br /> <br />Mary Sipe stated she felt the permit should not be issued until it is <br />decided where the ash is going. <br /> <br />Mr. Dan McConnon stated that #10 of the CUP should be made consistent <br />with the CUP for NSP. He further noted that he felt item #12 was overly <br />restrictive and felt buildings and facilities should be stricken. <br /> <br />Mr. McConnon requested that the language in #9 be changed to be a daily <br />average. <br /> <br />Mr. McConnon also <br />he had received <br /> <br />reviewed the status of Burlington Northern and stated <br />a letter granting approval for crossing.
