<br />Page 7 <br /> <br />City Council Minutes <br />February 9. 1987 <br /> <br />e <br /> <br />Mr. David Briggs stated he felt this type of zoning would offer a front <br />door for other businesses that will not properly portray Elk River. <br /> <br />Mr. Jack Maurey stated he felt this matter should be put up to the public <br />for a vote. <br /> <br />Ms. Peabody stated that she has watched the City grow. She stated she is <br />very concerned about the devaluation of the propety because of the RDF <br />Plant. <br /> <br />There being no further public comment. Mayor Gunkel closed the public <br />hearing. <br /> <br />The following comments were made by Council and Staff in answer to the <br />public comments: <br /> <br />Mayor Gunkel stated that State law establishes the guidelines in which <br />the City Council has to act regarding the rezoning. <br /> <br />Councilmember Dobel stated that the City has more authority regarding the <br />RDF with the rezoning of the property. <br /> <br />e <br /> <br />It was noted that regarding public awareness. this has been on the front <br />page of the local newspaper for two years and over 20 public hearings <br />have been held by the City. <br /> <br />Mr. Klovning stated that there has been one <br />regarding land devaluation near RDF plant. <br />study it was concluded that there were no <br />devaluation occurred within a five year study. <br />the City has not heard concerns from property <br />project. <br />COUNCILMEMBER SCHULDT MOVED TO APPROVE <br />AMEND ING THE CITY OF ELK RIVER ZONING MAP <br />SWF-SOLID WASTE FACILITY OVERLAY DISTRICT. <br />THE MOTION. THE MOTION PASSED 5-0. <br /> <br />major existing study done <br />He indicated that in the <br />specific cases where <br />Mayor Gunkel noted that <br />owners close to the RDF <br /> <br />ORDINANCE 87-2, AN ORDINANCE <br />TO ZONE NSP PROPERTY INTO THE <br />COUNCILMEMBER TRALLE SECONDED <br /> <br />5.4. Consider Conditional Use Permit Request by UPA/Public Hearing <br /> <br />The Building and Zoning Administrator noted <br />conditional use permit for UPA to operate <br />incorporates the Planning Commission's concerns. <br /> <br />that <br />a RDF <br /> <br />the newly drafted <br />Processing Plant <br /> <br />Counsel Peter Beck explained the conditional use permit at this time. <br /> <br />Counsel Beck gave a general statement regarding the City's authority with <br />regards to the conditional use permit and the zone change. <br /> <br />e <br /> <br />Mayor Gunkel noted that questions have been raised as to whether or not <br />she had a conflict of interest and she noted to the public that she had <br />looked into this matter and made a public statement to this affect at the <br />August 18. 1986 City Council Meeting. <br />
