A RESOLUTION <br />GRANTING SOLID WASTE FACILITY LICENSE TO UNITED POWER ASSOCIATION FOR THE <br />ESTABLISHMENT AND OPERATION OF A WASTE BURNING FACILITY WITH THE <br />FOLLOWING AMENDMENTS: <br /> <br />1) THAT /18 INDICATE THAT PERRFORMANCE TESTING WILL BE REQUIRED EVERY 9 <br />MONTHS FOR A 3 YEAR PERIOD FOR DIOXINS AND FURONS. <br /> <br />2) THAT *12 BE CHANGED SO AS TO BE CONSISTENT WITH THE CONDITIONAL USE <br />PERMIT FOR UPA. <br /> <br />COUNCILMEMBER SCHULDT SECONDED THE MOTION. THE MOTION PASSED 3-2. <br />COUNcILMEMBERS DOBEL . AND HOLMGREN VOTED AGAINST THE MOTION. <br /> <br />5.6. Consider Zone Change Request by NSP/Public Hearing <br /> <br />Peter Beck. Assistant City Attorney. explained that United Power <br />Association is requesting an ordinance amendment to amend the zoning map <br />to reflect the newly inacted solid waste facility overlay district. <br />Planning Commission Representative. Bob Morton. stated that the Planning <br />Commission recommended approval of the zone change. <br /> <br />e <br /> <br />There being no further public comment. Mayor Gunkel opened the public <br />hearing. <br /> <br />Al Fisher noted that the zone change would create an optimum hazard to <br />the City. He also indicated that the Council has received a petition of <br />over 600 names opposing the RDF Facility and questioned why this has not <br />been mentioned. <br /> <br />Mr. Dave Sipe stated the ROF would be posing traffic problems and <br />the burning of potentially hazardous material. He further indicated that <br />if this zone change is denied it would put a stop to the RDF. <br /> <br />Mr. Tom Woods stated that this is not a good place for the RDF Project. <br />He indicated it is inviting accidents into the community. He stated he <br />is disappointed in the democratic process and further stated he felt the <br />City is voting for the ROF Facility because of their fear of a lawsuit by <br />UPA or NSP. <br /> <br />Dr. Swan stated his concern regarding the schools being two miles from <br />the ROF Plant and indicated there must be a better place for the plant <br />than right downtown and close to the schools. <br /> <br />Mayor Gunkel closed the public hearing. <br /> <br />Mr. Klovning spoke on the concerns of the locations of the plant. He <br />indicated there are other ROF Plants located in similar locations. <br /> <br />e <br />
