<br />Page 11 <br /> <br />City Council Minutes <br />February 9. 1987 <br /> <br />e <br /> <br />Mayor Gunkel opened the public hearing. <br /> <br />Dave Briggs stated that he would like the license amended to state that <br />if an accident should occur. the plant would be shut down immediately <br />until the problem is corrected. <br /> <br />Mr. Dan McConnon stated that the MPCA permit requires extensive initial <br />testing. He further stated that the report is due 120 days after the <br />test is completed and questioned the reasoning of running a test every <br />three months when the results of the first test will not be available <br />before the second test is started. <br /> <br />Dr. Swan questioned <br />the pollutants. <br />Mr. Al Fisher stated <br />water every two weeks <br />in the same catagory. <br /> <br />if testing could be altered by artifically lowering <br /> <br />that industrial plants are required to test the <br />and questioned why the RDF Facility shouldn't fall <br /> <br />Jeanne <br />testing <br />validity <br />soil and <br /> <br />Eggert questioned if it were possible to add to the license that <br />would be done without warning. She stated she would doubt the <br />of the test unless this was added. She further stated that the <br />water should be tested. <br /> <br />e <br /> <br />There being no further public comment. Mayor Gunkel closed the public <br />hearing. <br /> <br />Assistant Attorney. Peter Beck stated that the City has the authority <br />under the Solid Waste Ordinance to suspend the license up to ten days <br />until a hearing is held if there is a violation of the license or the <br />ordinance resulting in a clear and eminent danger to te health and safety <br />of the City residents or the public. and also has the authority to keep <br />the plant shut down after a hearing until the problem is solved. <br /> <br />Mr. Klovning responded to the possibility of artificially lowering the <br />pollutants to alter the test. Mr. Klovning stated that even if this were <br />done it would not be a significant adjustment. Mr. Klovning noted that <br />surprise testing would be difficult because of the extensive amount of <br />testing required. He also noted that the soil. water and air will be <br />tested. <br /> <br />Councilmember Dobel questioned whether milk samples will be taken and <br />tested. Mr. Klovning indicated they would be tested. <br /> <br />Discussion was held regarding the possibility of testing every 9 months <br />in a three year span so that the results would be back before the next <br />test is started. <br /> <br />e <br />
