She felt the above concerns did not meet the <br />criteria for a hardship. She indicated the Council would be setting a <br />precedent if they allowed the variance. She indicated Mr. Smith's <br />property could be divided at such time that other surrounding properties <br />are sold. Mayor Gunkel also indicated that the Council denied a similar <br />request at the time of M-Vale Plat. <br /> <br />Councilmember Schuldt <br />surrounding land is <br />Councilmembers Tralle <br /> <br />indicated the variance was necessary because the <br />swamp and would be very difficult to develop. <br />and Dobel concurred with Councilmember Schuldt. <br /> <br />COUNCILMEMBER TRALLE MOVED TO APPROVE THE VARIANCE REQUESTED :BY GlRAtI) <br />SMITH FOR A 400 FOOT ENCROACHMENT ON THE 500 rOOT MAXIMUM LENGTH or A <br />DEADEND ROAD TO WITH THE FOLLOWING CONDITIONS: <br /> <br />1. THAT THE EASEMENTS SHOWN ON THE REVISED DRAWING BE D!DlCATKD TO Tim <br />CITY FOR ROAD PURPOSES PRIOR TO RECORDING THI LOT SPLIT. <br /> <br />2. There being no one for or <br />against the matter. Mayor Gunkel closed the public hearing. <br /> <br />COUNCILMEMBER SCHULDT MOVED TO APPROVE THE ADMINISTRATIVE SUBDIVISION <br />REQUESTED BY GERALD SMITH TO DIVIDE A 27.8 ACRE PARCEL OF LAND. LEGALLY <br />DESCRIBED AS "THE SW 1/4 OF SECTION 29. TOWNSHIP 33. RANGE 26. <br />SHERBURNE COUNTY. MINNESOTA LYING E OF M-VALE ACCORDING TO THE RECORDED <br />PLAT THEREOF. AND LYING. N OF THE NORTHERLY RIGHT-OF-WAY LINE OF THE <br />BURLINGTON NORTHERN RAILROAD" INTO 4 SEPARATE PARCELS WITH THE FOLLOWING <br />COND ITIONS : <br /> <br />1. THAT $600 IN PARK DEDICATION FEES BE PAID TO THE CITY FOR THE THREE <br />ADDITIONAL LOTS CREATED IN THIS SPLIT. <br /> <br />e <br /> <br />2.
