He stated he would like to see temporary <br />real estate office removed from the Ordinance as the two terms "model <br />home" and "temporary real estate office" are defining the same type of <br />business. <br /> <br />COUNCILMEMBER TRALLE MOVED TO APPROVE THE CONDITIONAL USE PERMIT <br />REQUESTED BY CHARLES CHRISTIAN TO ALLOW A TEMPORARY REAL ESTATE OFFICE <br />ON LOT 8. BLOCK 1. DEERFIELD 3RD ADDITION WITH THE FOLLOWING CONDITIONS: <br /> <br />1. THAT THE CONDITIONAL USE PERMIT FOR THE TEMPORARY REAL ESTATE OFFICE <br />BE ALLOWED FOR THE SAME TIME PERIOD ALLOWED FOR THE MODEL HOME. <br /> <br />2. THAT NO ADDITIONAL SIGNAGE FOR THIS TEMPORARY REAL ESTATE OFFICE BE <br />ALLOWED. <br /> <br />3. THAT THE HOURS FOR THIS TEMPORARY REAL ESTATE OFFICE BE FROM 8:00 <br />A.M. TO 9:00 P.M. <br /> <br />COUNCILMEMBER DOBEL SECONDED THE MOTION. <br />COUNCILMEMBER HOLMGREN' ABSTAINED. <br /> <br />THE MOTION CARRIED 4-0. <br /> <br />e <br /> <br />Counci1member Holmgren indicated he abstained due to a conflict of <br />interest. <br /> <br />The Council directed the staff to research the Planning Commissions' <br />recommendation to eliminate temporary real estate offices from the <br />ordinance and to better define model homes. <br /> <br />6.3. Variance Request/Gerald Smith/Public Hearing <br /> <br />Mayor Gunkel indicated that Jerry Smith is <br />encroachment on the 500 foot maximum length <br />accommodate a proposed lot split. <br /> <br />requesting a 400 foot <br />of a deadend road to <br /> <br />Dirk Barrett, Planning Commission Representative, indicated that the <br />Planning Commission recommended approval of the request. He indicated <br />the Planning Commission had a concern regarding access to potential <br />future development. <br /> <br />Mayor Gunkel opened the public hearing. There being no one for or <br />against the matter, Mayor Gunkel closed the public hearing. <br /> <br />e <br /> <br />The Council discussed the variance and indicated that the lay of the <br />land creates a hardship and also that the property does not have access <br />unless the deadend is extended and all other properties around are <br />developed. It was indicated that it could be a long time before the <br />other surrounding properties are developed. <br />
