<br />City Council Minutes <br />December 18, 1989 <br /> <br />Page 5 <br /> <br />e <br /> <br />the main reasons' for voting in favor of the request is that the <br />activity being considered would be located indoors and there would be <br />controls in place with the conditional use permi t and further that <br />the acti vi ty would require a license from the City. She further <br />indicated that the activity is consistent with the comprehensive <br />plan. <br /> <br />Mayor Tralle opened the public hearing. <br /> <br />Carol Mills of Zimmerman, MN, member of the Guardian Angels Board of <br />Directors, indicated that the Guardian Angels have been located in <br />their spot for 25 years and that they were an active participant in <br />the planning of the PUD. She indicated that they are not opposed to <br />retail office or normal mall activities. However, they are opposed <br />to what is being presented. Ms. Mills indicated that she was <br />speaking on behalf of the people who will be living permanently at <br />the Guardian Angels Foundation. She indicated that the Guardian <br />Angels have purchased more land which will bring them closer to the <br />proposed Parcel F. She further indicated that they are proposing to <br />build an addition on to their current building. Ms. Mills stated <br />that they are aware of what happened to the Bull' s Eye operation <br />concerning the loitering and are afraid that the proposed billiards <br />hall will breed a certain type of clientele and further that this is <br />an inappropriate use for the mall area. <br /> <br />e <br /> <br />Russell Johnson of 16274 Vernon Street NW, Andover, MN, indicated <br />that he is the applicant for the next item on the agenda which is a <br />conditional use permit for a billiards hall on Parcel F. He stated <br />that he would be responsible to the City and the landlord has control <br />over the operation. He indicated that besides this, there are also <br />controls through the conditional use permit and the license for the <br />billiards hall. Councilmember Kropuenske indicated that there could <br />be a potential problem with the hours of operation and the heavy <br />amount of traffic in the area. <br /> <br />There being no further comments from the public, Mayor Tralle closed <br />the public hearing. <br /> <br />The City Clerk stated that she received a letter from the Guardian <br />Angels Foundation opposing the conditional use permit request. She <br />further indicated that this letter would be made part of the official <br />record. <br /> <br />COUNCILMEMBER KROPUENSKE MOVED TO DENY THE REQUEST FOR A CONDITIONAL <br />USE PERMIT TO AMEND THE ELK RIVER PLAZA PUD. COUNCILMEMBER DOBEL <br />SECONDED THE MOTION. <br /> <br />e <br /> <br />Councilmember Holmgren indicated that the conditional use permit <br />could control this type of activity and if things did get out of hand <br />the license could be pulled. He indicated that there is a movie <br />theater already in the area and feels that this use would be <br />consistent with other uses in the area. <br />
