She further indicated that the Planning Commission felt that <br />zoning the western edge C-2 would be considered spot zoning. Mary <br />Eberley indicated that the Planning Commission is recommending <br />approval of the zone change request to have the eastern 140 feet of <br />the property zoned R-2b/townhouse multifamily residential and the <br />remainder of the lot to be zoned C-3/Highway Commercial. <br /> <br />Mayor Tralle opened the public hearing. <br /> <br />Mr. Carl Miller of 708 Auburn Street, stated that the commercial line <br />dividing the 140 foot R-2b zoning should be moved to the west in <br />order to be in alignment with the existing property to the north. <br /> <br />Mrs. Carl Benson of 548 Auburn indicated that she agreed with Mr. <br />Miller. <br /> <br />Mr. Rick Duggan of Zimmerman, MN, Chairman of Faith Fellowship <br />Church, indicated that the Faith Fellowship Church was willing to <br />compromise on the R-2b zoning by moving the line to the west 40 extra <br />feet creating 140 foot R-2b zone. He indicated that their intent was <br />to create a balance between the residential and commercial property <br />and further that the commercial property would not be exiting onto <br />Auburn Street. <br /> <br />e <br /> <br />Mr. Gary Santwire, representing Faith Fellowship indicated that the <br />property does not have a zoning designation at the present time. He <br />indicated that the 100 feet of residential on Auburn was originally <br />designed that way in order to create minimum housing on Auburn <br />Street. <br /> <br />There being no further comments from the public, Mayor Tralle closed <br />the public hearing. <br /> <br />Councilmember Holmgren referred to the petition which was received by <br />the Council on July 17, from the citizens in the neighborhood of the <br />Faith Fellowship Church. He indicated that the petition stated that <br />the residents would like the Council to consider zoning the area C-2 <br />instead of C-3. Councilmember Holmgren was concerned whether there <br />would be any egress onto Auburn Street and also stated his. concern <br />regarding the screening onto Auburn Street from the residential <br />property. Steve Rohlf indicated that this could be reviewed at the <br />time of site plan. He indicated that there may be the possibility <br />that the Council would not review the site plan if it were a <br />principal use. He also indicated that staff is aware of Council's <br />concern regarding screening and would take this into consideration at <br />the time of site plan review. <br /> <br />e <br /> <br />COUNCILMEMBER KROPUENSKE MOVED TO ADOPT ORDINANCE 89-21, AN ORDINANCE <br />AMENDING THE CITY OF ELK RIVER ZONING MAP TO ZONE THE AFFECTED <br />PROPERTY FROM PUD TO C-3/HIGHWAY COMMERCIAL AND R-2b/TOWNHOUSE <br />MULTIFAMILY RESIDENTIAL WITH THE EASTERN 140 FEET BEING <br />R-2B/TOWNHOUSE BASED ON THE PLANNING COMMISSION'S STATEMENT OF FACT <br />THAT IT IS CONSISTENT WITH THE COMPREHENSIVE PLAN AND ALSO THAT IT IS <br />
