Page 4 Elk River City Council Minutes March 20, 1989 e COUNCILMBMBER DOBEt MOVED TO ADOPT RESOLUTION 89-18, A RESOLUTION AUTHORIZING THE ST. CLOUD HOUSING AND REDEVELOPMENT AUTHORITY TO ADMINISTER THE SECTION a HOUSING PROGRAM WITHIN THE CITY LIMITS OF ELK RIVER. COUNCILMEMBER KROPUENSKE SECONDED THE MOTION. THE MOTION CARRIED 4-1. COUNCILMEMBER HOLMGREN VOTED AGAINST THE MOTION. Councilmember Holmgren indicated that he voted against the motion because he would like more time to receive input from the community, the HRA and the Planning Commission before making a decision on this item. 8.1 Variance Elk River United Methodist Church/Public Hearing Steve Bjork, Zoning Assistant, stated that the Elk River United Methodist Church of 1304 Main Street, is requesting a conditional use permit to expand the existing structure. He further stated that as the conditional use permit will be contingent upon the granting of a variance, he is requesting that the variance be heard first. Mr. Bjork noted that the United Methodist Church is requesting a 30' encroachment on the 50' setback requirements for churches. Mayor Tralle opened the public hearing at this time. e Ted Cornelius, Chairman of Methodist Church, reviewed He indicated that he felt therefore, was requesting the the Building Committee for the United the five standards for granting a variance. the church met all five standards and variance. Jerry Schroeder, Planning Commission Representative, indicated that the Planning Commission recommended approval based on the following findings of fact: 1. That the lot is of an irregular shape. 2. That the original church was built prior to the adoption of the ordinance. 3. That other churches are built with a setback of less than the 50' requirement. Mayor Tralle closed the public hearing at this time. Councilmember Schuldt stated that he is a neighboring resident of the church and that he has heard no concerns or adverse comments from anyone else in the neighborhood regarding the variance request. MOVED TO GRANT A VARIANCE REQUEST TO THE UNITED 1304 MAIN STREET FOR A 30' ENCROACHMENT ON THE 50' CHURCHES BASED ON THE FOLLOWING FINDINGS OF FACT. e 2. THAT THE ORIGINAL CHURCH WAS BUILT PRIOR TO THE ADOPTION OF THE ORDINANCE. 3. THAT OTHBR CHURCHES ARE BUILT WITH SETBACKS OF LESS THAN THE 50' REQUIREMENT.
