<br />Page 4 <br /> <br />Elk River City Council Minutes <br />March 20, 1989 <br /> <br />e <br /> <br />COUNCILMBMBER DOBEt MOVED TO ADOPT RESOLUTION 89-18, A RESOLUTION <br />AUTHORIZING THE ST. CLOUD HOUSING AND REDEVELOPMENT AUTHORITY TO <br />ADMINISTER THE SECTION a HOUSING PROGRAM WITHIN THE CITY LIMITS OF ELK <br />RIVER. COUNCILMEMBER KROPUENSKE SECONDED THE MOTION. THE MOTION CARRIED <br />4-1. COUNCILMEMBER HOLMGREN VOTED AGAINST THE MOTION. <br /> <br />Councilmember Holmgren indicated that he voted against the motion because <br />he would like more time to receive input from the community, the HRA and <br />the Planning Commission before making a decision on this item. <br /> <br />8.1 Variance Elk River United Methodist Church/Public Hearing <br />Steve Bjork, Zoning Assistant, stated that the Elk River United Methodist <br />Church of 1304 Main Street, is requesting a conditional use permit to <br />expand the existing structure. He further stated that as the conditional <br />use permit will be contingent upon the granting of a variance, he is <br />requesting that the variance be heard first. Mr. Bjork noted that the <br />United Methodist Church is requesting a 30' encroachment on the 50' <br />setback requirements for churches. <br /> <br />Mayor Tralle opened the public hearing at this time. <br /> <br />e <br /> <br />Ted Cornelius, Chairman of <br />Methodist Church, reviewed <br />He indicated that he felt <br />therefore, was requesting the <br /> <br />the Building Committee for the United <br />the five standards for granting a variance. <br />the church met all five standards and <br />variance. <br /> <br />Jerry Schroeder, Planning Commission Representative, indicated that the <br />Planning Commission recommended approval based on the following findings <br />of fact: <br /> <br />1. That the lot is of an irregular shape. <br /> <br />2. That the original church was built prior to the adoption of the <br />ordinance. <br /> <br />3. That other churches are built with a setback of less than the <br />50' requirement. <br /> <br />Mayor Tralle closed the public hearing at this time. <br /> <br />Councilmember Schuldt stated that he is a neighboring resident of the <br />church and that he has heard no concerns or adverse comments from anyone <br />else in the neighborhood regarding the variance request. <br /> <br />COUNCILMEMBER SCHULDT <br />METHODIST CHURCH OF <br />SETBACK REQUIRED FOR <br /> <br />1. THAT THE LOT I S OF AN IRREGULAR SHAPE. <br /> <br />MOVED TO GRANT A VARIANCE REQUEST TO THE UNITED <br />1304 MAIN STREET FOR A 30' ENCROACHMENT ON THE 50' <br />CHURCHES BASED ON THE FOLLOWING FINDINGS OF FACT. <br /> <br />e <br /> <br />2. <br /> <br />THAT THE ORIGINAL CHURCH WAS BUILT PRIOR TO THE ADOPTION OF THE <br />ORDINANCE. <br /> <br />3. THAT OTHBR CHURCHES ARE BUILT WITH SETBACKS OF LESS THAN THE <br />50' REQUIREMENT. <br />
