He <br />further stated that this may not be the best solution. however. sewer and <br />water dictates how the lot lines can be drawn. He further stated he has <br />not heard any negative comments regarding the proposed concept and that <br />the present market dictates the need for less expensive single family <br />homes. <br /> <br />Councilmember Schuldt stated that the density is the crucial question and <br />is opposed to the plat due to the density. <br /> <br />Mayor Tralle closed the public hearing. <br /> <br />COUNCIL MEMBER DOBEL MOVED TO APPROVE THE CONDITIONAL USE PERMIT FOR THI <br />REPLAT OF BLOCK 2. BARRINGTON PLACE PUD TO ALLOW CLUSTER HOMES WITH THE <br />FOLLOWING STIPULATIONS: <br /> <br />1. THAT THE CITY ENGINEER HAVE FINAL APPROVAL OF THE SPECIFICS FOR <br />SANITARY SEWER, WATER, STORM DRAINAGE AND ROADS WITHIN THE PLAT (32 <br />FT. WIDE FACE OF CURB TO FACE OF CURB. 7 TON DESIGN. URBAN SECTION <br />ROAD IS THE CITY'S CURRENT STANDARDS). <br /> <br />2. THAT THE DRAINAGE AND UTILITY EASEMENT AS SHOWN ON THE PRELIMINARY <br />PLAT BE REQUIRED. <br /> <br />e 3 . THAT THE COMPLETION DATE FOR THE IMPROVEMENTS IN THE PLAT ARE ONE <br />YEAR FROM THE DATE OF COUNCIL FINAL PLAT APPROVAL. <br /> <br />4. THAT THE COST OF THE IMPROVEMENTS WITHIN THE PLAT ARE COVERED BY 100% <br />LETTER OF CREDIT AND THAT FOR A ONE YEAR PERIOD AFTER CITY ACCEPTANCE <br />OF THESE IMPROVEMENTS, A 25% WARRANTY BOND IS ESTABLISHED IN FAVOR OF <br />THE CITY. <br /> <br />5. THAT THE DEVELOPER AGREEMENT AND MODIFICATION TO THE PUD AGREEMENI' <br />ARE BOTH REQUIRED FOR THIS PLAT. ALSO. THAT THE DEVELOPER REIMBURSE <br />THE CITY FOR THE COST OF THESE DOCUMENI'S. <br /> <br />6. THAT EXI STING SEWER AND WATER LINES BE HANDLED AS PER CITY ENGINEERS <br />RECOMMENDATION AND FURTHER THAT THE ADDITIONAL FIRE HYDRANT BE <br />REQUIRED. <br /> <br />7. THAT SETBACKS ARE 20 FOOT FRONT YARD. 5 FOOT SIDE YARD. AND 10 FOOT <br />REAR YARD. <br /> <br />8. THAT STREET LIGHTS ARE PROVIDED IN THE PLAT AND THAT THE COST AND <br />INSTALLATION BE PAID FOR BY THE DEVELOPER AND THE LOCATION BE <br />DETERMINED BY STAFF AND FURTHER THAT THE CITY PAY FOR THE ELECTRICITY <br />TO OPERATE THE LIGHTS. . <br /> <br />e <br /> <br />9. THAT THE DEVELOPER PAY $700 FOR THE FIRST SEAL COATING REQUIRED FOR <br />THE ROADS WITHIN THE PLAT. <br /> <br />10. THAT ONLY LOT 7, BLOCK 2, BE ALLOWED TO HAVE A DRIVEWAY ENTERING ON <br />6TH STREET. <br />
