THAT THE DEVELOPER BE CHARGED $5.000 FOR THE FIRST SEAL COATING <br />REQUIRED ON THE ROADS WITHIN THE PLAT. <br /> <br />14. THAT THE DEVELOPER GRANT THE CITY A LETTER OF CREDIT WHICH COVERS <br />100% OF THE COST OF THE IMPROVEMENTS IN THE PLAT. AND WHICH WILL STAY <br />IN EFFECT UNTIL SAID IMPROVEMENTS ARE. ACCEPTED BY THE CITY. FOR ONE <br />YEAR AFTER CITY ACCEPTANCE OF THE IMPROVEMENTS WITHIN THE PLAT, A <br />WARRANTY BOND IN THE AMOUNT OF 25% OF THE ORIGINAL LETTER OF CREDIT <br />WILL BE REQUIRED. <br /> <br />15. THAT AUBURN STREET. AS NOTED ON THE PLAT. BE CHANGED TO CARSON <br />STREET. <br /> <br />1~. THAT BOTH A DEVELOPER'S AGREEMENT AND PUD AGREEMENT ARE REQUIRED. <br /> <br />17. THAT SIGNAGE IN THE PLAT BE CONSISTENT WITH THE CITY'S SIGN <br />ORDINANCE ~ <br /> <br />18. THAT THE DEVELOPER REIMBURSE THE CITY FOR THE COST INCURRED REVIEWING <br />THIS PLAT PRIOR TO THE CITY COUNCIL ACTING ON THE FINAL PLAT. <br /> <br />COUNCILMEMBER KROPUENSKE SECONDED THE MOTION. THE MOTION CARRIED 3-2. <br />COUNCILMEMBERS DOBEL AND HOLMGREN OPPOSED. <br /> <br />The basis of the opposition was the park land reuqirement. <br /> <br />5.8. Consider Zone Change Request/City of Elk River/Public Hearing <br /> <br />Building and Zoning Administrator, Steven Rohlf, indicated that at the <br />December 19, 1988, Elk River City Council meeting, two of the thirteen <br />commercial zone changes proposed to accommodate the Growth Management <br />Plan were tabled until tonight. The areas that were tabled were areas 3 <br />and 11. <br /> <br />Area 11 <br /> <br />Steve Rohlf explained that area 11 is located south of County Road 12 and <br />east of Highway 169. He indicated that this area is currently zoned 1-1 <br />and the land use map identifies it as MR/medium density residential. <br /> <br />Mayor Tralle opened the public hearing. <br />
