The Council indicated that this would be a matter between <br />Mr. Vasser and the developers and that the City could not become <br />involved because there was no legal documentation showing the proposed <br />buffer zone. <br /> <br />Mayor Tralle closed the public hearing. <br /> <br />COUNCILMEMBER KROPUENSKE MOVED TO APPROVE THE PRELIMINARY PLAT OF <br />BAILEY-BECK ADDITION PROPOSED BY R & D DEVELOPMENT WITH THE FOLLOWING <br />STIPULATIONS: <br /> <br />1. That final approval of streets, water, grading and drainage be as <br />per Terry Maurer, City Engineer, that the approval is prior to <br />final plat approval of the plat. This should include the final <br />plat reflecting all the necessary easement to accomplish utilities. <br /> <br />2. That lots 2, 3, and 4, be given reasonable access to the City <br />water lines, but not be forced to hook up to them unless desired <br />by the owners and further that stub-in be provided. <br /> <br />3. That Fifth Street gain an additional 17 feet of right-of-way <br />through the dedication of this plat. <br /> <br />e <br /> <br />4. <br /> <br />That upgrading of Fifth Street is not required as part of this <br />plat approval. <br /> <br />5. That the developer gain approval of all the necessary permits from <br />other agencies such as: approval by the DNR for drainage <br />outletting to Lake Orono, Department of Health approval for water <br />main extension, and approval from Minnesota Pollution Control <br />Agency for sanitary sewer connection. <br /> <br />6. That the City's approval of this plat is contingent upon DNR <br />approval of the townhouse units. <br /> <br />7. That the approval of this plat is contingent upon the zone change <br />for those townhouse units being approved by the City. <br /> <br />8. That Tipton is a 32 foot wide face of curb to face of curb, urban <br />section road with concrete curb and gutter and a 7 ton design. <br />Final approval of these standard as per Terry Maurer, City <br />Engineer. <br /> <br />9. That the developer reimburse the City for all plating fees prior <br />to Council final plat review. This includes: $7,700 park <br />dedication fee, $750 first sealcoating fee for Tipton Avenue and <br />the estimated engineering costs, City Attorney fees and staff <br />time, as estimated by staff. <br /> <br />e <br /> <br />10. That prior to recording this plat, an $85,000 Letter of Credit in <br />favor of the City is provided by the developer for security on the <br />improvements that the City is to accept with this plat. <br />
