That street lights are provided on the corner of Upland andl"ifth, <br />Upland and Tipton, at the end of the cul-de-sac on Tipton, and on <br />Upland and Highway 10 on the south side of Highway 10. The lights <br />and the installation of them to be paid for by the developer, the <br />fee for running the lights to be paid for by the City. <br /> <br />12. That Lots 1 through 7, Block 2, have their lowest floor <br />approximately 878 feet above mean sea level. <br /> <br />13. That a townhouse association agreement is provided by the <br />developer and approved by the City Attorney prior to the Council <br />final plat approval. This to guarantee the maintenance of the <br />private drive to access those townhouses and the common lot <br />surrounding them. <br /> <br />14. That the townhouse units are provided two garage stalls each and <br />parking as shown on the preliminary plat and the private road and <br />parking is hardsurfaced. <br /> <br />15. That Lot 12, Block 2, is totally landscaped according to City Code <br />at time of building permit issuance. <br /> <br />e <br /> <br />16. That Lot 1, Block 1, is combined with other property to give it <br />access to Xenia Avenue, or designed an unbuildable outlot until <br />access is gained. This stipulation must be recorded on the <br />property and be made part of the developer's agreement to put <br />future purchases on notice. Further, that sewer and water <br />stub-ins for Lot 1, Block 1, not be required at this time, but be <br />the responsibility of whoever proposes to build on that lot. <br /> <br />This also must be recorded on the property and entered into the <br />developer's agreement. <br /> <br />17. That Lot 5, Block 3, be provided an additional 5 feet of frontage <br />to meet the City's minimum 80 foot frontage requirement. <br /> <br />COUNCILMEMBER DOBEL SECONDED THE MOTION. THE MOTION CARRIED 5-0. <br /> <br />6.3. Installation of Street Li~ht <br /> <br />Mayor Tralle indicated that the Council had received a memo from the <br />Police Chief regarding complaints received from concerned citizens on <br />the lack of street lighting at the entrances into the Industrial Park <br />off of County Road 1. <br /> <br />COUNCILMEMBER HOLMGREN MOVED TO AUTHORIZE THE INSTALLATION OF A STREET <br />LIGHT AT THE ENTRANCE INTO THE INDUSTRIAL PARK OFF OF COUNTY ROAD 1. <br />COUNCILMEMBER DOBEL SECONDED THE MOTION. THE MOTION CARRIED 5-0. <br /> <br />- <br /> <br />6.4. Deerfield 3rd Development A~reement Amendment <br /> <br />Lori Johnson, Finance Director, indicated that the Developers of <br />Deerfield 3rd are requesting that the City amend the Developers <br />
