<br />City Council Minutes <br />January 8, 1990 <br /> <br />Page 5 <br /> <br />- <br /> <br />3 for the purchase of the railroad property. He indicated that this <br />motion should have been made from the Council and requested that the <br />Council make the motion. <br /> <br />COUNCILMEMBER KROPUENSKE MOVED TO APPROVE THE USE OF EXCESS TIF FUNDS <br />FROM DISTRICTS 1 AND 3 FOR THE PURCHASE OF THE RAILROAD TRAIL AND TO <br />MOVE FORWARD WITH AMENDING THE DISTRICT MAP. COUNCILMEMBER HOLMGREN <br />SECONDED THE MOTION. THE MOTION CARRIED 4-0. <br /> <br />The City Administrator informed the Council that the conditional use <br />permits and licenses for both UPA and NSP will expire at the end of <br />this month. He indicated that the Zoning Administrator, Stephen <br />Rohlf, will be presenting this issue to the Council on 1/29/90, and <br />further that he will be requesting a time extension on the renewal of <br />the permit and license until the testing has been completed at the <br />burn plant. <br /> <br />. <br /> <br />The City Administrator informed the City Council that the MacGibbon <br />sidewalk court case has not progressed any further. He indicated <br />that the Judge, once again, has requested both sides to settle the <br />issue out of court. The City Administrator indicated that Mr. <br />MacGibbon has lowered his settlement demand to about $1,000. After <br />debate by the Council, it was the consensus that the City could not <br />pay Mr. MacGibbon $1,000, or any amount for the property, as the City <br />owns the property and the City would be setting precedence in paying <br />residents for city Right-of-way property. Councilmember Holmgren <br />suggested that the City pay Mr. MacGibbon, as the City will be losing <br />more money in Court costs than payment to Mr. MacGibbon. <br />Councilmember Kropuenske stated that he felt if the City did pay Mr. <br />MacGibbon, they would be setting a long range precedent. <br /> <br />e <br /> <br />The City Administrator informed the City Council that he has met with <br />Mr. Morrell and made him an offer of $250,000 for his approximately <br />3.2 acre site and relocation expenses. He indicated that Mr. Morrell <br />has rejected this offer and is requesting approximately $325,000. <br />Mayor Tralle indicated that the traffic is still very heavy around <br />School Street and it still creates a hazard for the area residents <br />and the children going to school. The City Administrator stated that <br />it continues to be a City goal to see Mr. Morrell relocate to a <br />better site. The Council discussed the condition of the Morrell <br />property and the fact that the property was in violation of the <br />zoning ordinance. It was the consensus of the Council that the City <br />staff proceed to enforce the zoning code. <br /> <br />e <br /> <br />Mayor Tralle suggested offering Mr. Morrell $280,000 for the site and <br />if Mr. Morrell does not accept the offer within 30 days, negotiations <br />for the property cease. Councilmember Schuldt stated that he felt <br />the City has been more than fair with Mr. Morrell and indicated that <br />he does not want to raise the City's offer of $250,000. <br />Councilmember Holmgren indicated that he would like to let the offer <br />of $250,000 stay "on the table" for about 90 days until the Community <br />Center Task Force has had an opportunity to set some priori ties for <br />space needs within the City.
