<br />Elk River City Council Minutes <br />December 16, 1991 <br /> <br />Page 3 <br /> <br />. <br /> <br />indicated that direct access to the outside of the building is proposed <br />and there is no proposed exit from the pizza parlor into the mall area. <br /> <br />Councilmember Kropuenske indicated his concern regarding double parking <br />along the curb for pizza pick ups. Tom Zerwas, Police Chief, indicated <br />that although this could create a problem, it would not be considered <br />illegal because the area is not marked as a no parking zone. <br /> <br />COUNCILMEMBER SCHULDT MOVED TO APPROVE THE BUILDING PLAN AND SITE PLAN <br />REVIEWS FOR THE PROPOSED OFFICE SPACE AND LITTLE CEASER'S PIZZA PARLOR <br />WITH THE STIPULATION THAT "NO PARKING, FIRE LANE" SIGNAGE BE INSTALLED <br />IN FRONT OF LITTLE CEASER'S. COUNCILMEMBER HOLMGREN SECONDED THE <br />MOTION. THE MOTION CARRIED 4-0. <br /> <br />COUNCILMEMBER KROPUENSKE MOVED THAT "NO PARKING, FIRE LANE" SIGNAGE BE <br />INSTALLED FOR THE ENTIRE CURB LINE ALONG THE MALL AREA. COUNCILMEMBER <br />HOLMGREN SECONDED THE MOTION. THE MOTION CARRIED 4-0. <br /> <br />6.3. Zoninr Interpretation of Proposed Ostrich Farm <br /> <br />. <br /> <br />Steve Rohlf indicated that Howard and Donna Dell are requesting a <br />zoning interpretation regarding the raising of ostriches. He stated <br />that Janelle Szklarski, Zoning Assistant, indicated that it was staff's <br />interpretation that ostri ches would be considered a wild animal. He <br />indicated that after the Dells requested an interpretation, .Janelle <br />Szklarski further researched the issue. Steve Rohlf indicated that <br />aft.er research of t.he issue, staff's recommendation was split with the <br />Community Service Officer recommending that ostriches are wild animals <br />and not allowed in agrieultural use areas and with Janelle Szklarski' s <br />interpretation being changed to state that ostriches be treated as an <br />agricultural use because they are being used primarily for breeding <br />purposes and also because research indicates that other communi ties <br />have not experienced any problems. Steve Rohlf indicated that he <br />concuned with .Tanelle's recommendation, but felt that if the Council <br />also concurred, the City should look at its entire animal ordinance. <br /> <br />Mayor Tralle felt that it would be appropriate to refer this item to <br />the Planning Commission for review. He indicated that the Planning <br />Commission should look at other ordinances that deal with animals on <br />smaller lots of five acres in size and further that he would like the <br />Planning Commission to consider whether animals that are wild by nature <br />should be regulated by a conditional use permit or be considered as a <br />primary use. <br /> <br />. <br /> <br />Councilmember Kropuenske indicated that he concurred with Janelle <br />Szklarski 's interpretation as he felt the ostriches were more of an <br />agricultural operation. He further indicated that if it was the <br />Council's desire to send this item back to the Planning Commission, he <br />would request that it be a priority for the Planning Commission so as <br />not to delay the Dell's. <br /> <br />It was the consensus of the City Council that the ostriches be <br />considered wild animals by nature and not be allowed as an agricultural <br />
